RESOLUTION NO. 91-12 A RESOJJUTION SETTING FORTH THE REZONING OF LOT 3, BLOCK D, M1HRLYN ACRES, TRACT 1201, BEING A PORTION OF THE NW~ SECTION 26, TOWNSHIP 19 NORTH, RANGE 22 WEST, FROM: C-1 (NEIGHBORHOOD COMMERCIAL) ZONE, PROPOSED TO BE: C-2H/1A (HIGHWAY COMMERCIAL/ONE ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 3, 1990, a public hearing was conducted to determine whether approval should be granted to Oscar Santa Maria, of Ontario, California for a rezoning from existing C-l (Neighborhood Commercial) zone to C-2H/IA (Highway CommerCial/One Acre Minimum Lot Size) zone, located between Los Gauchos and teller Roads on the east side of Highway 95, located in the South Mohave Valley area, and WHEREAS, the subject property is located on the east frontage of Highway 95 approximately 150 feet south of Los Gauchos Road. Review of floodplain map #040058-2445C indicates this area is in a FEMA designated floodplain. This property is currently vacant and surrounding land uses consist of a gas station to the north and vacant land on the south and east. There are residences to the east but there are intervening R-M designated parcels. The applicant wishes to establish a car sales business, and .... ...... - -q . ~A6E 2 Qf 3 BK 1841 PG 1001 (FEE091- 2022) Page 2 Resolution No. 91-12 WHEREAS, the South Mohave Area plan allows for this commercial land use, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on December 12, 1990 did generate a recommendation of approval of this zone change request contingent upon the following: 1. Zoning for this parcel be a C-2H/IA (General Commercial Highway Frontage/One Acre Minimum Lot Size) zone. 2. The applicant comply with all applicable provisions of Sections 25, 26, 27, & 31 of the Mohave County Zoning Regulations. 3. Arizona Department of Water Resources approves the water supply and distribution system. 4. Arizona Department of Environmental Quality approves the quantity and quality of the water supply. 5. Arizona Department of Environmental Quality approves the use and design of the sewage treatment facility for this development. 6. All paving (driveways and parking, to include sales lot area) be paved in accordance with Mohave County Standard Specification #171 or better, and that such paving be completed within ninety (90) days of the certification of occupancy granted the building. All storage areas shall be covered with a dust-proof surface. I f crushed rock is used for the dust-proof surface, then the soil shall be maintained in a weed free condition. 7. Building/Zoning permit(s) shall be obtained. 8. An ADOT access permit be obtained. 9. The development shall have adequate parking facilities. 10. That a buffer, in the form of a six (6') foot block wall shall be required along the entire boundary where commercial uses and zoning abut single family 'lII .... _ ~ . 411tAGE 3 OF 3 BK 1841 PG 1002 (FEE~91- 2022) Page 3 Resolution No. 91-12 residential zones. 11. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors, being February 7, 1991, as per ARS 11-829E. 12. I f these conditions are not met wi thin one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on December 21, 1990, and posted December 20, 1990 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, January 7, 1991 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
