RESOLUTION NO. 91-11
A RESOLUTION SETTING FORTH THE REZONING OF LOT 2, BLOCK S, GOLDEN
SHORES UNIT 8, IN SECTION 11, TOWNSHIP 16 NORTH, RANGE 21 WEST,
FROM: ,C-2 (GENERAL COMMERCIAL) ZONE, PROPOSED TO BE: C-2H
(HIGHWAY_COMMERCIAL) ZONE, LOCATED IN THE SOUTH MOHAVE VALLEY
AREA, MOHAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on January 7, 1991, a public hearing was
conducted to determine whether approval should be granted to
Larry W. Sawka, Topock, Arizona for a rezoning from existing C-2
(General Commercial) zone to C-2H (Highway Commercial) zone,
located at the corner of Highway 95 and Maricopa Road, located in
the South Mohave Valley area, and
WHEREAS, the subject property is accessed from the Highway
95
and
Oatman-Topock
junction
in
Golden
Shores,
north
approximately 1/2 mile to the northwest corner of Highway 95 and
Maricopa Road. Review of floodplain map #040058-2805C indicates
this area is clear of flooding potential.
The current use of
this property is vacant land. Surrounding land uses consist of a
boat sales to the south and mostly vacant land with some
res idences in the other directions.
The applicant wishes to
combine this lot with Lot 1 on the south side into one lot and
thereby expand the boat sales operation in conjunction with

meeting minimum lot requirements for C-2H zones, and
WHEREAS, the South Mohave Area plan allows for this change,
and
WHEREAS, a public hearing before the Mohave County Planning
and Zoning Commission on December 12, 1990 did generate a
recommendation of approval of this zone change request contingent
upon the following:
1. The applicant comply with all applicable provisions of
Sections 25, 26, 27, & 31 of the Mohave County Zoning
Regulations.
2. Submittal and recordation of a Parcel Plat prepared in
accordance with Article 3.16 of the Mohave County
Subdivision Regulations.
3. Lots 1 & 2 be combined through the parcel plat
procedure. (Lot 2 has insufficient area for a C-2H
zone and therefore must be combined with Lot 1).
4. The establishment of a minimum lot size based on the
size of the combined parcels per the recorded Parcel
Plat.
5. The Parcel Plat shall show any surface drainage.
6. The zoning for these combined parcels be C-2H/15M
(General Commercial Highway Frontage/Fifteen Thousand
Square Foot Minimum Lot Size) zone.
7. The development shall have adequate parking facilities.
8. Arizona Department of Water Resources approves the
water supply and distribution system.
9. Arizona Department of Environmental Quality approves
the quantity and quality of the water supply.

10. Arizona Department of Environmental Quality approves
the use and design of the sewage treatment facility for
this development.
11. All paving (driveways and parking) be paved in
accordance with Mohave County Standard Specification
#171 or better, and that such paving be completed
within ninety (90) days of the certification of
occupancy granted the building. All storage areas
shall be covered with a dust-proof surface. If crushed
rock is used for the dust-proof surface, then the soil
shall be maintained in a weed free condition.
12. Building/Zoning permit(s) shall be obtained.
13. The rezone shall not become effective for at least
thirty (30) days after final approval of the change in
classification by the Board of Supervisors, being
February 7, 1991, as per ARS 11-829E.
14. If these conditions are not met within one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the rezoning shall schedule a
public hearing to grant an extension, determine
compliance with the schedule for development or cause
the property to revert to its former zoning
classification in accordance with Arizona Revised
Statutes Annotated, Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona on December 21, 1990, and posted December
20, 1990 as required by Arizona Revised Statutes, and the Mohave
County Zoning Regulations, and
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, January 7, 1991 approved this

change in zoning as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
