HomeMy WebLinkAbout91-045 ,~ , . 0.00 He RESOLUTION NO. 91-45 A RESOLUTION SETTING FORTH THE REZONING OF A PORTION OF THE N~ NW~ SE~ SE~ SW~ SECTION 12, TOWNSHIP 17 NORTH, RANGE 18 WEST, FROM: A (GENERAL) ZONE, PROPOSED TO BE: R-l/16M (SINGLE FAMILY RESIDENTIAL/SIXTEEN THOUSAND SQUARE FOOT MINIMUM LOT SIZE) ZONE, LOCATED IN THE YUCCA AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 4, 1991, a public hearing was conducted to determine whether approval should be granted to Roy L. Carl ton of Yucca, Arizona for a rezoning from existing A (General) zone to R-1/16M (Single Family Residential/Sixteen Thousand Square Foot Minimum Lot Size) zone, located one quarter (.25) mile south of the Yucca Townsite in the Yucca area, and WHEREAS, the subject property is located just south of Yucca Townsite and west of 1-40. It is accessed off of 1-40 at the Yucca interchange, then south approximately 2 1/2 miles on the southwestern 1-40 frontage road, then 1/4 mile west on an unnamed ingress/egress easement, and WHEREAS, review of floodplain map #040058-2675B indicates this area to be clear of flooding potential. Surrounding land uses to the north and east consist of single family residential, mobile and site built homes, and some commercial. Undeveloped ....... -... -' --... The applicant wishes to split this 1.25 acre lot into two 20,000+ square foot parcels. This density is similar to other nonconforming splits that have occurred in the past, and WHEREAS, this is a zoning enforcement case, and WHEREAS, a public hearing before the Mohave County Planning and zoning Commission on January 9, 1991 did generate a recommendation of approval of this zone change request contingent upon the following: 1. Submittal and recordation of a Parcel Plat prepare~ in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 2. The establishment of a minimum lot size based on the size of parcels per the recorded Parcel Plat. 3. Each parcel shall have legal access. 4. Each parcel shall meet or exceed sixteen (16,000) thousand square feet exclusive of road easements. 5. The Parcel Plat shall show any surface drainage or FEMA flood zones. 6. That the Board of supervisors accept the dedication of a thirty-three (33') foot right-of-way along with an eight (8 ') foot PUE contiguous to this property on unnamed roadway easements on the north and west boundaries of this lot in conjunction with a twenty (20 ') foot radius at the intersection of the above mentioned easements. This shall be approved through the recording of the resolution authorizing this zone change, and that the dedication statement and dedication be shown on the Parcel Plat. 7. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors, being March 4, 1991, as per ARS 11-829E. I ..' ;, . . Resolution No. 91-45 Page 3 8. I f these conditions are not met wi thin one (1) year this approval shall be void. I f at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on January 18, 1991, and posted January 17, 1991 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, February 4, 1991 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
