PAGE 1 OF 3 BOB RECORDING fEE 0.00 He RESOLUTION NO. 91-41 A RESOLUTION SETTING FORTH CONDITIONAL APPROVAL OF A REQUEST TO ABANDON (REVERSION TO ACREAGE) OF ONE (1) LOT WITHIN THE DESERT LAKES GOLF COURSE AND ESTATES, TRACT 4076-C, SECTION 36, TOWNSHIP 19 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MORAVE VALLEY AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held February 4, 1991 a public hearing was conducted to determine whether approval should be granted to Angelo Rinaldi, Desert Lakes Development, LP, of Santa Ana. California, for an abandonment (reversion to acreage) of one (1) lot within the Desert Lakes Golf Course and Estates, Tract 4076- C, Section 36, Township 19 North, Range 22 West, located in the South Mohave Valley area, as shown in Exhibit "A", and WHEREAS, this abandonment (reversion to acreage) is located in Desert Lakes Golf Course and Estates, Tract 4076-C, which is located approximately one (1) mile east of Highway 95 off Lipan Boulevard, and WHEREAS, the abandonment (reversion to acreage) proposed is that of Lot 42, Block M of the above referenced subdivision. Lot 42 can be found north of Lipan Boulevard on Mountain View Road approximately 700 feet, to Desert Lakes Drive east 2400 feet, '\ Resolution No. ~1 &-AGE 2 OF !age 2 BK 1851 PG 237 (FEE~91- 6317) then north approximately 150 feet on Crystal Drive, where Lot 42 is located on the west side of this street, and WHEREAS, the abandonment (reversion to acreage) of Lot 42 is being proposed along with the abandonment of a portion of Parcel R-R of this same subdivision so that this portion of Parcel R-R may be combined with Lot 42 to create a new lot with greater square footage, and WHEREAS, as required by Mohave County Subdivision Regulation #1.12-7, the applicant has provided a petition for the above abandonment, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on January 9, 1991 did generate a recommendation of conditional approv~l of this abandonment with the following conditions noted: 1. That the described property as shown in exhibit "A" shall be reverted to acreage. 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations for the newly created lot depicting the new lot lines. 3. That any and all easements be shown on this plat, and the new easements should be granted to the public through this instrument. 4. The newly created lot shall be designated as Lot 42-A and shall be referenced and referred to by a metes and bounds description. 5. If these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board , Resolution No. ~1 . Page 3 PAGE 3 OF 3 BY. 1851 PG 238 (FEE~91- after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to ,its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. 6317) WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, and Mohave Valley News, on January 18 and 25, 1991, and posted January 18, 1991 as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, February 4, 1991 approved this abandonment request (reversion to acreage) as recommended by the Mohave County Planning and Zoning Commission, subject to the condition outlined herein.
