HomeMy WebLinkAbout91-040 ,'{ ) ~~. . 2~ 0.00 He RESOLUTION NO. 91-40 A RESOLUTION SETTING FORTH CONDITIONAL APPROVAL OF A REQUEST TO ABANDON A PORTION OF A PUBLIC UTILITY EASEMENT AND DRAINAGE EASEMENT LOCATED WITHIN THE DESERT LAKES GOLF COURSE AND ESTATES, TRACT 4076-C, SECTION 36, TOWNSHIP 19 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MORAVE VALLEY AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held February 4, 1991 a public hearing was conducted to determine whether approval should be granted to Angelo Rinaldi, Desert Lakes Development, LP, of Santa Ana. California, for an abandonment of a portion of a public utility easement and drainage easement located within the Desert Lakes Golf Course and Estates, Tract 4076-C, Section 36, Township 19 North, Range 22 West, located in the South Mohave Valley area, and WHEREAS, this abandonment is located in Desert Lakes Golf Course & Estates, Tract 4076-C, which is located approximately one (1) mile east of Highway 95 off Lipan Boulevard, and WHEREAS, the abandonment in question is the portion of Parcel R-R, which lies between Lots 41 & 42 of Block M of this subdivision. Lots 41 & 42 of Block M can be found by proceeding north on Mountain View Road from Lipan Boulevard approximately .. ." 700 feet, then east on Desert Lakes . Page 2 ~AGE 2 OF J BK 1851 PG 234 (FEEt9l- 6316) Drive approximately 2400 Resolution No. 941tO ./ feet, then north 130 feet on Crystal Drive where this portion of Parcel R-R may be found on the west side of Crystal Drive, and WHEREAS, as required by Mohave County Subdivision Regulation No. 1.12-7, the applicant has provided a petition for the above abandonment, and WHEREAS, a public hearing before the Mohave County Planning and zoning Commission on January 9, 1991 did generate a recommendation of approval of this abandonment with the following conditions noted: 1. That the requisite agencies concur witp the abandonment of the aforementioned easements per exhibit "A". 2. If this condition is not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general.circulation in Kingman, Mohave County, Arizona, and Mohave valley News, on January 18 and 25, 1991, and posted January 18, 1991 as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations, and . Page 3 ~ NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, February 4, 1991 approved this abandonment request (reversion to acreage) as recommended by the Mohave County Planning and Zoning Commission, subject to the condition outlined herein.
