PAGE 1 OF 4 BOS REClJROn~G fEE 0.00 He RESOLUTION NO. 91-35 A RESOLUTION SETTING FORTH THE REZONING OF A PORTION OF THE NE~ NE~ NE~ SECTION 18, TOWNSHIP 41 NORTH, RANGE 6 WEST, FROM: A-R (AGRICULTURAL RESIDENTIAL) ZONE, PROPOSED TO BE: C-M (COMMERCIAL MANUFACTURING) ZONE, LOCATED SOUTH OF COLORADO CITY, ARIZONA IN THE ARIZONA STRIP AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 4, 1991, a public hearing was conducted to determine whether approval should be granted to Deseret Land & Trust, Colorado City, Arizona for a rezoning from existing A-R (Agricultural Residential) zone to C-M (Commercial Manufacturing) zone, located south of Colorado City, Arizona in the Arizona Strip area, and WHEREAS, Section 18 is three miles south of the Utah-Arizona Border and west of Highway 389. The subject property is accessed from the Berry Knoll Boulevard and Highway 389 junction south on Berry Knoll Boulevard approximately 1/2 mile to the southwestern corner of Berry Knoll Boulevard and Industrial Road. Section 18 and a portion of Section 13 (in Range 7 West) are commonly known as Centennial Park and are planned by Deseret Trust to be developed as a community, and .. WHEREAS, the subject property _AGE 2 OF BK 1851 PG is approximately three acres Page 2 ~ 224 (FEE~91- 6313) Resolution No. 9~ in size. Review of floodplain map #040058-0109B indicates this area to be clear of flooding potential. Surrounding land uses consist of vacant land to the north and east with residential uses to the west and south. Deseret Trust is in the process of preparing and submitting a concept plan for their community. The plan staff reviewed indicated some proposed commercial uses south of this parcel. The applicant has indicated proposed uses for this property will be sewing/manufacturing of cloth items, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on January 9, 1991 did generate a recommendation of approval of this zone change request contingent upon the following: 1. The applicant comply with all applicable provlSlons of Sections 25, 26, 27, & 31 of the Mohave County Zoning Regulations. 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The Parcel Plat shall show any surface drainage. 4. The establishment of a minimum lot size based on the size of parcels per the recorded Parcel Plat. 5. Arizona Department of Environmental Quality approves the use and design of the sewage treatment facility for this development. 11. All driveways and parking be paved and all paving shall be in accordance with Mohave County Standard Specification #171 or better, and such paving be completed within ninety (90) days of the certification of occupancy granted the building. 12. Building/Zoning permit(s) shall be obtained. 13. That the Board of Supervisors accept the dedication of a forty-two (42') foot right-of-way along with an eight (8') foot PUE contiguous to this property on Industrial Road and Berry Knoll Boulevard, in conjunction with a twenty (20') foot radius at the intersection of the above mentioned roads. This shall be approved through the recording of the resolution authorizing this zone change, and that the dedication statement and dedication be shown on the Parcel Plat. 14. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors, being March 4, 1991, as per ARS 11-829E. 15. If these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, The Daily Spectrum, and Desert Echo on January 18, 1991, and posted January 20, 1991 as required by Arizona Revised Statutes, and the Mohave County zoning Regulations, and ~ . 1 , Resolution No. 9~ . Page 4 PAGE 4 OF 4 BK 1851 PG 226 (FEE~91- 6313) NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, February 4, 1991 approved this change in zoning as recommended by the Mohave County Planning and zoning Commission and outlined herein.
