A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT TO
ESTABLISH A RESIDENCE IN A C-2 (GENERAL COMMERCIAL) ZONE, LOCATED
IN THE KINGMAN AREA, MOHAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held January 7, 1991 a public hearing was
conducted to determine whether approval should be, granted to
James & Laura Brice of Kingman, Arizona for a Zoning Use Permit
to establish a residence in a C-2 (General Commercial) zone,
located in Sunhaven Homesites Unit #13, Lot 13, located on the
east side of Able Drive and approximately 300 feet south of
Sunhaven Lane in the Kingman area, and
WHEREAS, Sunhaven subdi v is ion is bounded by Diagonal Way,
Northern Avenue, and Highway 66. Lot 13 is accessed from Highway
66 via Sunhaven Lane west to Able Drive,
thence south
approximately 400 feet on the east side of the street. Review of
floodplain map #040058-2165C indicates this area to be clear of
flooding potential, and
WHEREAS, surrounding land uses consist of residential uses
to the west and south; vacant land to the east and one vacant
parcel then two commercial uses to the north. There remains the

possibility that the vacant lot to the north could have a
commercial use.
However, there are few commercially occupied
lots in this subdivision although the lots east of Able Drive
have been zoned commercial, and
WHEREAS, a public hearing before the Mohave County Planning
and Zoning Commission on December 12, 1990 did generate a
recommendation of conditional approval of the Zoning Use Permit
with the following conditions:
1. That Zoning/Building permit(s) be obtained.
2. If construction or use has not commenced within one (1)
year of Board approval of the Zoning Use Permit or if
the use has been discontinued for six (6) months, then
approval shall terminate at that date.
3. This Zoning Use Permit is subject to revocation upon
sixty (60) days notification by the Board of
Supervisors, if in the opinion of the Commission and
Board the continued use of the property would be
contrary to the public health, safety, and welfare.
4. That the home shall be used as a residence only and
shall not be used in conjunction with the underlying C-
2 (General Commercial) zoning. If the underlying C-2
zoning were to be exercised by the owner of the
property then a rehearing of this ZUP would be
required.
5. I f these conditions are not met within one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the rezoning shall schedule a
public hearing to grant an extension, determine
compliance with the schedule for development or cause
the property to revert to its former zoning
classification in accordance with Arizona Revised
Statutes Annotated, Title 11, Chapter 6, 11-832.

WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona on December 21, 1990, and posted December
20, 1990 as required by the Arizona Revised Statutes and the
Mohave County Zoning Regulations, and
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, January 7, 1991 approved this
Zoning Use Permit as recommended by the Mohave County Planning
and Zoning Commission, subject to the conditions outlined herein.
