RESOLUTION NO. 91-75 A RESOLUTION SETTING FORTH CONDITIONAL APPROVAL OF THE REZONING OF A PORTION OF PARCEL 57, SUNWEST ACRES, TRACT 1027, BEING IN SECTION 19, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM: A-R/lOA (AGRICULTURAL RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-R/lA (AGRICULTURAL RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 1, 1991, a public hearing was conducted to determine whether approval should be granted to Herb Gollis, owner's agent for George & Kathleen Webb of Kingman, Arizona, for a rezoning from existing A-R/10A (Agricultural- Residential/Ten Acre Minimum Lot Size) zone to A-R/IA (Agricultural Residential/One Acre Minimum Lot Size) zone) located on Teddy Roosevelt Road approximately 2,000 feet south of Redwall Drive, located in the Golden Valley area, and WHEREAS, Section 19 is located approximately 6 miles west of the Highway 68 & 93 junction and approximately 1 1/2 miles south of Highway 68. The subject property is accessed from Highway 68 via Teddy Roosevelt Road south approximately 2 miles on the east side of the road, and '> Resolution No. 9.5 . Page 2 WHEREAS, review of floodplain map #040058-2325B indicates that a portion of this parcel may be within a designated floodplain. Surrounding land uses consist of one mobile home and mostly vacant land. The applicant desires to split this 20+ acre parcel into two 4+ parcels and one 9+ acre parcel. The map indicates the access to the rear 9+ acre parcel to be a 20 I access road between the front 4+ acre parcels, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on February 13, 1991, there was generated a recommendation of DENIAL of the zone change request from the Planning and Zoning Commission. Specifically, the recommendation of denial was generated due to inconsistency of development with the surrounding property as well as the type of split requested, and the design of this split, and WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on February 17, 1991, and posted February 15, 1991 as required by Arizona Revised Statutes and the Mohave County Zoning Regulations, and WHEREAS, the Board of Supervisors at their regular meeting on Monday, March 4, 1991 referred this matter back to the Planning and Zoning Commission for further review and evaluation, based upon a request of the applicant to have the Planning Commission review a redesign of the proposed lot split and access, and PAGE 2 OF 4 BK 1871 PG 50 CFEEt91-15538) . 10 ... 1.. .... Page 3 WHEREAS, the applicant indicated to the Commission that he wishes to have the Commission reconsider it's previous decision of denial based on a redesign of the proposed lot split. The applicant upon conferring with Commission feels the redesign will be more in keeping with the character of the area and also facilitate access to surrounding parcels. WHEREAS, at their meeting on Wednesday, March 13, 1991, the Planning and zoning Commission recommended APPROVAL of the proposed zone change and resultant lot split contingent upon the following conditions: 1. The two western parcels be zoned A-R/4A (Agricultural- Residential/Four Acre Minimum Lot Size) and the eastern parcel be zoned A-R/9A (Agricultural-Residential/Nine Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The establishment of a minimum lot size based on the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access. 5. The two western parcels shall meet or exceed four (4) acre and the eastern parcel meet of exceed nine (9) acres exclusive of road easements. 6. The Parcel Plat shall show any surface drainage or FEMA flood zones. 7. That the Board of Supervisors accept the abandonment of the eastern fifty (50') feet of Teddy Roosevelt Road as it is contiguous to this property to be replaced by the dedication of a forty-two (42') foot right-of-way and eight ( 8') foot PUE as they are contiguous to this property on Teddy Roosevelt Road. In addition, the dedication of two (2) thirty (30') foot right-of-ways along the northern and southern boundary of this parcel and eight (8') foot PUE's as they are contiguous to the above mentioned boundaries. In addition, twenty (20') radii at the intersection of above mentioned roadways and Teddy Roosevelt Road. This shall be approved through the recording of the resolution authorizing this zone change, and that the dedication statement and dedication be shown on the Parcel p~t. 3 OF 4 BK 1871 PG 51 (FEEt91-15538) '"' .... \.....~, Resolution AIt 91-75 . Page 4 8. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors, being May 1, 1991, as per ARS ll-829E. 9. I f these conditions are not met wi thin one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was republished in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on March 17, 1991, and posted March 15, 1991 as required by Arizona Revised Statutes and the Mohgave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 1, 1991 APPROVED this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
