PAGE 1 OF 4 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He RESOLUTION NO. 91-74 A RESOLUTION SETTING FORTH THE REZONING OF THE E~ NW\ AND NE\ SW\ OF PARCEL 69, SECTION 17, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM: A-R/I0A (AGRICULTURAL RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-R/1A (AGRICULTURAL RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 4, 1991, a public hearing was conducted to determine whether approval should be granted to Thomas C. Day of Kingman, Arizona for a rezoning from existing A- R/10A (Agricultural Residential/Ten Acre Minimum Lot Size)) zone to A-R/1A (Agricultural Residential/One Acre Minimum Lot Size) zone, located south of Shipp Drive between Santa Maria and Verde Roads, located in the Golden Valley area, and WHEREAS, Section 17 is located approximately 5 miles west of the Highway 68 and 93 junction and approximately 1/2 mile south of Highway 68. The subject property is accessed from Highway 68 via Verde Road south approximately 1/2 mile to Shipp Drive thence west approximately 800 feet on the south side of the road. This parcel is bounded on three sides by the Rancho Verde, Tract 3011 subdivision, and . .AGE 2 OF 4- BK 1560 PG 499 (FEE~91- 10562) Resolution No. 91-74 Page 2 WHEREAS, review of floodplain map #040058-2325B indicates this area to be clear of flooding potential, and WHEREAS, the applicant desires to split this 7+ acre parcel into two 1+ acre parcels and one 3.5+ acre parcel. It is possible that eventually this parcel will be split into 4 or 5 parcels similar to the surrounding density of Rancho Verde. At this time the applicant can only split the parcel into three pieces but has made provisions for the future splitting by another owner, and WHEREAS, the Commission in deliberation of this request did note that this parcel was an enclave as it is surrounded by a one (1) acre type subdivision development. That the creation of these splits, although conducive to extended metes and bounds resubdivision, the design was consistent with surrounding development, and WHEREAS, a public hearing before the Mohave County Planning and zoning Commission on February 13, 1991 did generate a recommendation of approval of this zone change request contingent upon the following: 1. The two southern parcels be zoned A-R/1A (Agricultural- Residential/One Acre Minimum Lot Size) and the northern parcel be zoned A-R/3A (Agricultural-Residential/Three Acre Minimum Lot Size). . ~AGE 3 OF 4 BK 1860 PG 500 (FEEt91- 10562) Page 3 Resolution No. 91-74 2. Submittal and recordation of a Parcel plat prepared in accordance with Article 3.16 of the Mohave County Subdivision negulations. 3. The establishment of a mlnlmum lot size based on the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access. 5. The two southern parcels shall meet or exceed one (1) acre and the northern parcel meet of exceed three (3) acres exclusive of road easements. 6. The Parcel Plat shall show any surface drainage or FEMA flood zones. 7. That the Board of Supervisors accept the abandonment of the southern fifty (50') feet of Shipp Drive as it is contiguous to this property to be replaced by the dedication of a forty-two (42') foot right-of-way and eight ( 8') foot PUE as they are contiguous to this property on Shipp Drive. In addition, the dedication of a forty (40') foot right-of-way and eight (8') foot PUE along the north 775 feet of the eastern boundary of this parcel and a twenty (20' ) radius at the intersection of this roadway, to be named Toms Way, and Shipp Drive. In addition there shall be provisions made for a turn around at the terminus of this access in accordance with and meeting the standards set forth in Mohave County regulations. This shall be approved through the recording of the resolution authorizing this zone change, and that the dedication statement and dedication be shown on the Parcel Plat. 8. A one (1') foot vehicle non-access easement located on a separate parcel and a physical barrier a minimum of four (4') feet in height will need to be provided for the eastern boundary of this parcel and the e.asement and parcel shall be shown and dedicated via the parcel plat. 9. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors, being April 4, 1991, as per ARS 11-829E. .. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on February 17, 1991, and posted February 15, 1991 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, March 4, 1991 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
