RESOLUTION NO. 91-67
A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT TO
ESTABLISH A MOBILE HOME PARK IN AN A-R (AGRICULTURAL RESIDENTIAL)
ZONE, LOCATED IN A PORTION OF GOVERNMENT LOT 3, SECTION 3,
TOWNSHIP 18 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MOHAVE
VALLEY AREA, MOHAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held March 4, 1991 a public hearing was conducted
to determine whether approval should be granted to Mark LaPorte
of Lake Elsinore, California for a Zoning Use Permit to establish
a mobile home park in an A-R (Agricultural Residential) zone,
located in a portion of Government Lot 3, Section 3, Township 18
North, Range 22 West, located one-half (.5) mile west of the
Boundary Cone and Highway 95 intersection and one-half (.5) mile
north of the western extension of Boundary Cone Road, located in
the South Mohave Valley area, and
WHEREAS, Section 3 is a "half-section" located approximately
5 miles south of Bullhead City and has frontage on the west side
of Highway 95.
The subject property is located in the western
half of the section and north of the midsection line. Access is
provided off of Highway 95 on the western extension of Boundary
Cone Road thence west 1/2 mile to an existing sixty foot right-

of-way thence north 1/2 mile to the property. The developer will
improve this access if this permit is granted, and
WHEREAS, review of floodplain map #040058-2445C indicates
this area to be in a designated floodplain.
Surrounding land
uses consist of vacant land and Fort Mojave Indian Reservation
(FMIR) land to the west. The park plan proposes the creation of
244 lots on this forty acre parcel. The average lot size is not
indicated but there are four varieties of lot sizes called out on
the plans, and
WHEREAS, the plans show provisions for recreation area and a
package sewage treatment plant, and
WHEREAS, a public hearing before the Mohave County Planning
and Zoning Commission on February 13, 1991 did generate a
recommendation of conditional approval of the Zoning Use Permit
with the following conditions:
1. A modification to the design of the park is made to
preserve the existing roadway and PUE's on the property
to ensure legal access to neighboring parcels.
2. The applicant submit requisite plans and reports in
accordance with Section 27-1 of the Mohave County
Regulations for review and approval by the Commission.
3. The applicant comply with all applicable provisions of
Sections 25, 26, 27, and 31 of the Mohave County Zoning
Regulations.

4. These lots will not be for sale unless or until they
have been approved as subdivided parcels by Mohave
County Planning and Zoning and have met all
requirements of the State of Arizona.
5. A buffer, in the form of a six (6 t) foot block wall
shall be required along the boundaries of this parcel.
The block wall to be constructed when/if surrounding
land developes.
6. Arizona Department of Water Resources approves the
water supply and distribution system.
7 . Arizona Department of Environmental Quality approves
the quantity and quality of the water supply.
8. Arizona Department of Environmental Quality approves
the use and design of the on-site sewage effluent
collection network. Sewerage facilities are available
in this area and the County is not recommending
proliferation of package plants when hookup to an
accepted s,ewage system is feasible and in accordance
with the 208 Plan for this site area. Therefore, Staff
is recommending the plant shown on the plans be deleted
and future plans indicate hook up to an outside sewer
system. In addition, documentation of an agreement to
hook up to such a facility shall be submitted.
9. The existing unnamed ingress and egress easements be
paved within this parcel as well as provision of paved
access to the nearest paved county road (Highway 95).
In addition, all interior streets and parking shall be
paved. All paving shall be in accordance with Mohave
County Standard Specification #171 or better.
10. That Zoning/Building permit(s) be obtained.
11. If construction or use has not commenced within two (2)
years of Board approval of the Zoning Use Permit or if
the use has been discontinued for one (1) year r then
approval shall terminate at that date.
12. This Zoning Use Permit is subject to revocation upon
sixty (60) days notification by the Board of
Supervisors, if in the opinion of the Commission and
Board the continued use of the property would be
contrary to the public health, safety, and welfare.

WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona on February 17, 1991, and posted February
20, 1991 as required' by the Arizona Revised Statutes and the
Mohave County Zoning Regulations, and
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, March .4, 1991 approved this
Zoning Use Permit as recommended by the Mohave County Planning
and Zoning Commission, subject to the conditions outlined herein.
