WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held March 4, 1991 a public hearing was conducted to determine whether approval should be granted to Brent Allen, P.E. of Ace Engineering, Bullhead City, Arizona, for an abandonment of a twenty-five (25) foot alley in the W~ Section 7, . WEST Township 17 North, Range 21 3uuth, located in the South Mohave Valley area, and WHEREAS, this request is directly tied into the design of Desert Arroyo, Tract 4116. The design was under review by staff in November and staff felt this item should be tabled until the Commission and the developer could come to an agreement on the design of this tract. In addition the abandonment has a direct impact on one of the County I s wells which serves the local Sheriffs office and public works maintenance yard, and WHEREAS, this request has since been evaluated by the Commission and a modification of the original petition was -~ . .AGE 2 Of 3 BK 1860 PG 464 (FEE~91- 10554) Resolution No. 91-66 Page 2 considered by the Commission. PAGE 2 OF 3 BK 1865 PG 528 (FEEt91- 13063) The modification relates to the access and location of the aforementioned well site. Approval of the modified petition will not eliminate access to the well site and ownership of the site will be retained by the County, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on February 13, 1991 did generate a recommendation of approval of this abandonment with the following conditions noted: 1. Compliance with Board of Supervisors Resolutions 91-6 & 91-7. 2. Legal access to Mohave County's well and well site shall be retained. 3. Abandonment shall apply only to the twenty-five (25 ') foot alley bisecting lots 2049-2058 & 2168-2173, as illustrated on the approved Del ta City, #5, Tract 1208-A. The alley which is illustrated on the preliminary plan shall be dedicated via the final plat recordation. 4. This abandonment shall not become effective until the final plat for this tract is recorded. Furthermore, a request for the abandonment and reversion to acreage of the old Delta City lots shall be submitted for evaluation and recommendation prior to final recordation. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, and Mohave Valley News, on February 17 and 24, 1991, and posted February 20, 1991 as required by the "",-- ~ ('~flGE 3 OF :3 ,"~K 1860 pIj %5 (FEE~91- 1ll554) Resolution No. 91-66 Page 3 Arizona Revised Statutes and the Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, March 4, 1991 approved this abandonment request as recommended by the Mohave County Planning and Zoning Commission, subject to the condition outlined herein.
