RESOLUTION NO. 91-63
A RESOLUTION SETTING FORTH APPROVAL OF A PRELIMINARY SUBDIVISION
PLAN FOR MOON VALLEY, TRACT 4120, BEING A SUBDIVISION OF A
PORTION OF THE NE~ SW~ SECTION 25, TOWNSHIP 19 NORTH, RANGE 22
WEST, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY,
ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on March 4, 1991, a public hearing was
conducted to
determine the
approval
of
the preliminary
subdivision plan for Moon Valley, Tract 4120, and
WHEREAS, the owners/developers of this tract are Delmar L.
and Janice K. Tilton of Port Orchard, washington. The
engineering firm responsible for the preparation of the overall
plan
and
the
drainage
study
is
Territorial
Engineers,
Incorporated of Bullhead City, Arizona, and
WHEREAS, this proposed subdivision is located approximately
2.5 miles south of Bullhead City's southern most boundary and is
approximately 1.25 miles east of Highway 95.
Moreover, this
project is accessible via Highway 95, south to Joy Lane, then
east approximately one (1) mile to the intersection of Joy Lane
and Mountain View Road, then north approximately one half (~)
mile to Hammer Lane, then east one quarter (~) mile to Van

Mouwerick, then south approximately .25 mile to Moon Valley,
Tract 4121, and
WHEREAS, the preliminary plan depicts approximately five (5)
acres subdivided into sixteen (16) individual lots. The proposed
minimum lot size for this project will be 9,800 square feet with
a maximum lot size being proposed as 12,375 square feet.
This
property is bordered on the north by the proposed Sun Desert
subdivision, on the south by the proposed Pine River Estates
subdivision, on the west by Tierra Del Rio, Tract 4048-D., and on
the east by unsubdivided properties. These projects are located
on the western alluvial slope of the Black Mountains and are
subject to flash flooding and sheet flow runoff. The Pine River
Estates subdivision, Sun Desert Estates subdivision and the Moon
Valley Tract, have been consolidated into one comprehensive
drainage study, and
WHEREAS, the South Mohave Valley Area Plan has designated
this area as having a potential for single family residences.
The overall density for this project will be approximately 3.2
units per acre, and
WHEREAS, water service will be provided by the Bermuda Water
Company, Inc. This property proposes to have private individual
disposal systems for sewage disposal.

within the Mohave Valley Irrigation and Drainage District, and
WHEREAS, the Commission at their meeting on February 13,
1991 did recommend conditional approval of the preliminary
subdivision plan and petition of exception for Tract 4120, with
the following noted:
1. Petitions of exception were submitted for the following
exceptions:
a. All street sections are to be inverted crown in
lieu of standard crown.
b. Eight (8') foot public utility easements on lot
frontage instead of sixteen (16') foot rear lot
utility easements.
The special circumstances or conditions which warrant
these deviations from the design standards are as
follows:
a. Native type soils erode easily on minor storms and
inverted streets will help control shoulder erosion
and reduce County maintenance expenses.
b. The power company is not requiring over head
facilities at the rear of lots. Thus they prefer
the eight (8') foot PUE along the front lot lines.
Commission recommends approval of the Petition of Exceptions
based on the aforementioned justifications.
2. The conditional approval of this subdivision is based
on the understanding of the Planning and Zoning
Commission that all streets within the subdivision will
be constructed and paved with asphaltic concrete in
accordance with Standard Specifications #171 and
#101.10D or better; the streets shall include curb and
gutter; use of inverted crowns is accepted; a water
supply and distribution system including fire flow will
be constructed to serve each lot; grading and drainage
related improvements will be made as recommended by the
design engineer in the submitted drainage reports;
arrangements will be made to extend underground
electric and telephone service to each lot in

accordance with Arizona Corporation Commission
regulations; approval for water system and sewage
disposal shall be obtained from the Arizona Department
of Environmental Quality prior to recording the Final
Plat; water availability statement to be obtained from
the Arizona Department of Water resources; all lots and
street centerline monuments will be staked and
monumented in accordance with Standard Specification
#102; fire hydrants will be provided at locations
prescribed by the Fort Mojave Mesa Fire Department;
street name and regulatory signs will be installed in
accordance with the requirements of the Mohave County
Subdivision Regulations and as recommended by the
design engineer and; the owner/subdivider is
responsible for the completion of improvements and
shall provide assurance for all required subdivision
improvements in accordance with Article V of the
Subdivision Regulations.
3. The developer will make the same commitments for
improvements in the prospectus to the State Real Estate
Commission as is required for approval of this tract by
the Board.
4. A corporate entity for this project shall be formed for
provisions of perpetual maintenance for this project's
block walls, drainage easements, or any other
facilities deemed private in nature.
5. The Arizona Department of Environmental Quality
approves the water supply and distribution system.

7. A draft of the CC&R's shall be submitted to the
Planning and Zoning Commission staff for retention in
the master file of this tract.
8. It is the Mohave County policy that if the method of
controlling runoff utilizes street rights-of-way of
this or adjacent developments, this runoff shall be
ei ther contained wi thin the improved or paved roadway
section or in ditches removed from the improved roadway
section. The purpose of this is to attempt to minimize
future maintenance to the County.

Van Mouwerick shall be abandoned prior to recordation
of the final plat.
10. Van Mouwerick Drive shall be dedicated as a sixty (60')
foot right-of-way and a five (5') foot roadway
easements/PUE's with an eight (8') foot PUE on either
side which total thirteen (13') feet of roadway
easement and PUE.
11. A twenty five (25') foot front building setback line
along Van Mouwerick shall be established from the front
lot line. (This requirement to be included in the
zoning Resolution)
12. The County Engineer has made comments in regard to the
drainage report and the preliminary plan as submitted,
the questions involving drainage have been addressed in
the documentation with the project engineer by staff,
and the Commission is confident that all concerns will
be addressed and resolved to the County Engineer's
satisfaction prior to submission of this subdivision to
the Board of Supervisors for Final Plat actions.
Should there be a substantial redesign of the
preliminary plan as presented, due to changes in the
drainage plan as presented, the owner/subdivider will
be required to resubmit this subdivision as a revised
preliminary plan for review and consideration.
13. Staff has made several technical observations
concerning this plat. These observations shall be
reflected on the new preliminary submittal and staff
will provide the project engineer with these
observations in a written response. The new
preliminary plan submittal shall be accompanied by all
documents pertinent to the continued processing of this
tract as a final plat.
14. Recordation shall be held if provisions are not made to
insure the access road into this development will be
improved in the event developments to the north are not
in place when this tract is recorded.
15. A new preliminary plan shall be submitted prior to
final plan submittal in order for the Planning Director
to determine whether or not the proper revisions have
been completed.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, March 4, 1991, conditionally
approved this preliminary subdivision plan and petitions of
exception as recommended by the Mohave County Planning and Zoning
Commission and outlined herein.
