PAGE 1 OF ~ ;Oti RECORDING FEE 0.00 Me RESOLUTION NO. 91-51 c1i V ). f' / )_c" '\ \ f ; _ i \" ' l'1 , A RESOLUTION SETTING FORTH APPROVAL OF A PRELIMINARY SUBDIVISION PLAN FOR HORIZON ESTATES, TRACT 3030, AND ASSOCIATED PETITION OF EXCEPTION, A SUBDIVISION OF PARCEL 3, ROADWAY & UTILITY EASEMENT PLAT OF SECTION 12, TOWNSHIP 21 NORTH, RANGE 19 WEST, G&SRB&M, LOCATED IN THE GOLDEN VALLEY AREA, .MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 4, 1991, a public hearing was conducted determine the approval of the preliminary to subdivision plan for Horizon Estates, Tract 3030, and WHEREAS, the owner/developer of this tract is D & S Investments, Incorporated of Bullhead City, Arizona, and WHEREAS, the engineering firm responsible for the preparation of the design of this subdivision is Mohave Engineering Associates, Incorporated of Kingman, Arizona and WHEREAS, this proposed subdivision is located approximately 7.5 miles west of the junction of Highways 68 & 93 and fronts upon Highway 68' s northern border. Moreover, this property is located at the northeast corner of Highway 68 and Hoover Road. This proposed subdivision is located on approximately forty (40) acres of land, currently zoned A-R/10A (Agricultural " Resolution No. 9~1 aGE 2 OF 5Page 2 BK 1851 PG 276 (FEE~91- 6327) Residential/Ten Acre Minimum Lot Size). This property is bordered on the north by Chino Drive and Golden Sage Ranchos #51, and on the east and west by unsubdivided land, and WHEREAS, the developer of this project is proposing 220 condominium dwelling units, fifty-two (52) duplex units, seven (7) 16 unit apartment complexes, a 75,000 square foot commercial center, and a wastewater treatment plant. In addition, one parcel in the center of the tract will be utilized as a park area while two other parcels will be used as swimming pool and recreation areas in the north half of the project, and WHEREAS, water service is being proposed through the Golden Valley Improvement District I and all properties will be connected to each dwelling unit and transported by gravity sewers and a lift station to the wastewater treatment facility located on the project site, and WHEREAS, the road pattern is integrated with all exiting and potential roads in the area. The interior roads and parking areas will be paved as well as Hoover Road from Highway 68 to Chino Drive and Chino Drive from Hoover to Stewart Mountain Road. Moreover, Supai Drive, between Hoover Road and Stewart Mountain Road will be paved, and WHEREAS, the Golden Valley Area Plan has already been amended to allow for this development. The rezoning proposal will follow at a later date, and " Resolution No. 9~1 . Page 3 PAGE 3 OF 5 BK 1851 PG 277 (FEE~91- 6327) WHEREAS, the Commission at their meeting on January 9, 1991 did recommend conditional approval of the preliminary subdivision plan for Tract 3030, with the following noted: 1. A petition of exception request is submitted as follows: a. Article 6.6-1 states that blocks shall not be greater than 1320 feet in length. b. Intersection less than two hundred (200') feet is being proposed for D'Angelo Loop from the existing intersection of Hoover Road and Chino Drive. c. Forty (40') foot wide street right-of-way for private streets. d. Ten (10') foot PUEjCE along lot frontage. The special circumstances or conditions which warrant these deviations from the design standards are as follows: a. Block lengths present no specific problems. b. Intersection less than 200 feet is not a major intersection. c. Proposed width of pavement, along with the ten (10') foot PUEjCE on either side of the right-of-way will not create any detriment to the public. d. The power company is not requlrlng overhead facilities at the rear of the lots. Thus they prefer the eight (8') foot PUE along the front lot lines. The Planning and Zoning Commission recommends approval of these petitions of exception based on the aforementioned justifications. 2. The conditional approval of this subdivision is based on the understanding of the Planning and Zoning Commission that all streets within the subdivision will be constructed and paved with asphaltic concrete in accordance with Standard Specifications 4/: 171 and 4/: 10 1. 10Dor better. More specifically, parking areas will be paved as well as Hoover / Resolution No. 9~1 .AGE 4 OF ~age 4 BK 1851 PG 278 (FEE~91- 6327) Road from Highway 68 to Chino Drive and Chino Drive from Hoover to Stewart Mountain Road and Supai Drive, between Hoover Road and Stewart Mountain Road will be paved. All interior streets shall have curb and gutter. A water supply and distribution system will be constructed to serve each lot. Grading and drainage related improvements will be made as recommended by the design engineer. Electric and telephone service shall be provided to each lot in accordance with Arizona Corporation Commission Regulations. All lots and street centerline monuments will be staked and monumented in accordance with Standard Specification #102 of the County Engineering Road Standards. Fire hydrants will be provided at locations prescribed by the Golden Valley Fire Department. Street name and regulatory signs will be installed in accordance with the requirements of the Mohave County Subdivision Regulations and as approved by the Commission. The owner/subdivider is responsible for the completion of improvements and shall provide an assurance for all required subdivision improvements in accordance with Article V of the Mohave County Subdivision Regulations. 4. A one (1') foot vehicular non-access easement shall be provided for any double fronted lots. 5. The one ( 1 ') foot vehicular non-access easements as designated on the plat will have a six (6') foot minimum block wall erected upon it to ensure non-access. 6. All common area, Le. parks, swimming pools, private streets, shall be labeled as a parcel to be maintained by a corporate entity. 7. A corporate entity for the administration of the CC&R's for this project be formed for provisions of perpetual maintenance for this project's block walls, drainage parcels, parks or any other facilities deemed private in nature. 8. Abandonment of eight (8') feet of the southern fifty (50') foot roadway easement adjacent to this project's northern border shall be approved prior to submittal of this project's final plan. 9. An agreement between the Golden Valley Improvement District #1 and the owner/subdivider shall be provided prior to recordation of the final plat indicating water will be supplied to this tract. 10. The County Engineer has made comments in regards to the drainage report and the preliminary plan as submitted, the questions involving drainage have been addresse~ in the documentation with the project engineer by staff, and the Planning Commission is confident that all concerns will be addressed and resolved to the County Engineer's satisfaction .. . Should there be a substantial redesign of the preliminary plan as presented, due to changes in the drainage plan, the owner/subdivider will be required to resubmit this subdivision as a revised preliminary plan for review and consideration. 9.1 6327) 11. The developer will make the same commitments for improvements in the prospectus to the State Real Estate Commission as is required for approval of this tract by the Board. 12. Arizona Department of Health Services approves the water supply and distribution system. 13. The water system will provide adequate flows for fire protection. Fire hydrants conforming to the minimum County standards shall be provided and located no more than seven hundred fifty (750') feet apart and/or fire hydrants acceptable to the Golden Valley Fire Department at the location(s) they prescribe. 14. The owner/subdivider shall cause the drainage related improvements to be completed as recommended by the project engineer and outlined in the detailed drainage report. 15. A draft of the CC&R's shall be submitted. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, February 4, 1991, conditionally approved this preliminary subdivision plan and petitions of exception as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
