PAGE 1 OF ~ aDs RECORDING FEE 0.00 He RESOLUTION NO. 91-50 A RESOLUTION SETTING FORTH THE REZONING OF THE W~ W~ PARCEL 90, SUNWEST ACRES, TRACT 1027, UNIT tf:!, SECTION 29, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM: A-R/I0A (AGRICULTURAL RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-R/2A (AGRICULTURAL RESIDENTIAL/TWO ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE GOLDEN VALLEY AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 4, 1991, a public hearing was conducted to determine whether approval should be granted to Inge Licon of Kingman, Arizona for a rezoning from existing A-R/10A (Agricultural Residential/Ten Acre Minimum Lot Size)) zone to A- R/2A (Agricultural Residential/Two Acre Minimum Lot Size) zone, occupying the southeast corner of Bolsa Drive and San Pedro Road, located in the Golden valley area, and WHEREAS, Section 29 is located approximately 6 miles west of the Highway 68 and 93 junction and approximately 2 1/2 mile south of Highway 68. The subject property is accessed from Highway 68 via Verde Road south approximately 2 1/2 miles to Bolsa Drive thence west approximately 1/2 mile to the southeast corner of Bolsa Drive and San Pedro Road which this parcel occupies, and WHEREAS, review of floodplain map #040058-2325B indicates this area is clear of potential flooding. The 6326) consist of mostly vacant land with some area to the west is vacant and the rest of the area has widely scattered residential uses. The applicant wishes to split this 5 acre parcel into two 1+ acre parcels and one two+ acre parcel. If this rezone were to be approved the density would be higher than the surrounding area, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on January 9, 1991 did generate a recommendation of approval of this zone change request contingent upon the following: 1. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 2. The establishment of a mlnlmum lot size based on the size of parcels per the recorded Parcel Plat. 3. Each parcel shall have legal access. 4. Each parcel shall meet or exceed two (2) acres exclusive of road easements. The Commission upon review of area densities recommends a two (2) parcel split only, modifying the applicant's request. 5. The Parcel Plat shall show any surface drainage or FEMA flood zones. 6. That the Board of Supervisors accept the abandonment of the south fifty (50') feet of Bolsa Drive and the east fifty (50') feet of San Pedro Road as they are contiguous to this property to be replaced by the dedication of a forty-two (42') foot right-of-way along Bolsa Drive and a thirty-five (35') foot right-of-way along San Pedro Road and an eight (8') foot PUE contiguous to this property on the above mentioned roads in conjunction with a twenty (20') foot radius at the intersection of Bolsa Drive and San Pedro Road. This shall be approved through the recording of the resolution authorizing this zone change, and that the dedication statement and dedication be shown on the Parcel Plat. ~-- Resolution No. ~O tit Page 3 PAGE 3 OF 3 BK 1851 PG 274 (FEE~91- 6326) 7. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors, being March 6, 1991, as per ARS 11-829E. 8 . I f these conditions are not met wi thin one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. \ WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on January 18, 1991, and posted January 17, 1991 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, February 4, 1991 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
