RESOLUTION NO. 91-133 A RESOLUTION SETTING FORTH APPROVAL OF A FINAL SUBDIVISION PLAN OF AZTEC JUNCTION, TRACT 3019-A, BEING A RESUBDIVISION OF PART OF LOTS 46 & 47 RECORD OF SURVEY MAP, FEE NO. 75-20615, SAID TRACT IS THE RESIDENTIAL PORTION OF AN OVERALL PRELIMINARY PLAT, TRACT 3019. TRACT 3019-A CONSISTS OF THIRTY-EIGHT (38) ACRES DIVIDED INTO 175 LOTS AND SEVEN (7) PARCELS IN SECTION 10, TOWNSHIP 21 NORTH, RANGE 18 WEST AT THE SOUTHWESTERLY CORNER OF THE INTERSECTION OF HIGHWAY 68 AND AZTEC ROAD IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the special meeting of the Mohave County Board of Supervisors held on May 1,1991, a public hearing was conducted to determine the approval of the final subdivision plan, for Aztec Junction, Tract 3019-A located in the Golden Valley area, and WHEREAS, the owner/subdivider of this tract is Aztec Junction One Limited Partnership, Jim Kuden, General Partner, of Escondido, California. The engineer of record on this project is John Proffit, Mohave Engineering Inc., 405 E. Beale Street, Kingman, Arizona 86401, and WHEREAS, this proposed subdivision is located three (3) miles west of the junction of Highways 93 and 68, is south of Highway 68 and is between Aztec and Arivaca Roads. This 51.16 acre site is just west of Golden Sage Ranchos Unit #55 and extends south of the highway to Shipp Drive, and --.. Resolution No. ~133 .-~ ~ Page 2 PAGE 2 OF 6 BK 1883 PG 872 (FEEt91-21455) WHEREAS, The approved preliminary subdivision plan depicts fifty-one (51) acres subdivided into 153 lots. The three (3 ) lots fronting on Highway 68 range in size from 1.15 to 4.30 acres and are proposed to be zoned C-2 (General Commercial). However, they are not included with this Final Plat. The remainder of the tract or 38.4 acres is proposed to be subdivided into 150 residential lots. These lots range in size from 6,000 to 10,000 square feet for a density of 3.9 lots per acre, and WHEREAS, Section 10, Township 21 North, Range 18 West is currently zoned A-R/10A (Agriculture-Residential/Ten Acre Minimum Lot Size), and WHEREAS, the Golden Valley Area Plan contemplated that any zone change application would include a specific site development plan, and WHEREAS, the owner/subdivider is required to abandon a portion of the roadway easement for Avra Road within the exterior boundaries of this tract, and WHEREAS, it is intended that this subdivision will be developed as a "walled" community where lots will be served from interior streets only. The streets will be paved private roads and the walls will be in the form of a six (6') foot high block wall. The plan includes a clubhouse, pool and recreation area on a one ( 1) acre parcel in the center of the residential lot subdivision. All of these amenities and improvements shall be , Resolution No. /"'~''', ''133 /"~""'I, Page 3 '''-...../ PAGE BK 3 OF 6 1883 PG 873 (FEE~Vl-21455) ~ maintained by a property owner's association, which is a corporate entity, and WHEREAS, t.he Arizona Department of Transportation is designing proposed improvements to and along Highway 68 which may affect the drainage patterns and designate permitted and improved entrances to and from Highway 68, and WHEREAS, the approval of this subdivision is based on the understanding that th,a perimeter roadways which serve as access to this subdivision are to be improved and paved with asphaltic concrete, Standards #171 & #101.10D; the interior roads which are I intended as private streets will also be paved with asphaltic ! , t. concrete to minimum County standards (#171 & #101.10D) or better; Valley Pioneer Water Company is to supply water to this tract and the own.erjsubdivider shall install a water distribution system to serve each lot with.in the subdivision; fire hydrants shall be provided in accordance with the requirements of the Mohave County Subdivision Regulations; sewage disposal is to be handled by a sewage treatment: facility to be located on Parcel B; grading and drainage related improvements will be made as recommended by the project engineer in the drainage report; arrangements will be made to extend undergl:ound electric and telephone service to each lot in accordance with Arizona Corporation Commission Regulations; all street centerline monuments will be staked and monumented 'in accordance with Mohave County Standard Specification No. 102; street name and regulation signs will be installed in accordance with Mohave County Subdivision Resolution No. ~133 . Page 4 PAGE 4 OF 6 BK 1883 PG 874 (FEEt91-21+55) Regulations; a wall and/or decorative barrier shall be constructed around the perimeter of the residential lot subdivision and as a condition of approval the owner/subdivider is responsible for the completion of these site improvements and shall provide an assurance for all required subdivision improvements in accordance with Article V of the Mohave County Subdivision Regulations, and WHEREAS, a portion of the subject property is within a FEMA designated floodplain, Zone A. The plan as designed includes drainage parcels which are aligned with and intercept storm runoff from Highway 68 and route storm water through the subdivision within a drainage parcel/channel which follows the natural water course. This channel is to be improved to carry a 100-year flow through this subdivision. Runoff from the east will be intercepted and carried by Aztec Road. The entire post development runoff can be carried in the streets, and NOW THEREFORE BE IT RESOLVED, that the Board approves the said final plan conditional to the following: 1. The developer will make the same commitments for improvements in the Subdivision Questionnaire to the Real Estate Commission as required for approval of this tract by the Board. A copy of the draft and final report delivered to the Arizona State Real Estate Department shall be submitted to the County; 2 . Arizona Department of the water and sewer subdivision; Environmental Quality approves system installation for this 3. The water system will provide adequate flows for fire protection. Fire hydrants conforming to the minimum county standa.rds shall be provided and positioned in acceptable locations to the Golden Valley Fire Department. . - Resolution~. 91-133 _AGE BK Page 5 5 OF 6 1883 PG 875 (FEEt91-21~55) 4. The owner/subdivider shall cause the drainage related improvements to be completed as recommended by the project engineer and outlined in the detailed drainage report as approved by staff, these improvements shall include any applicable comments within the Public Works letter dated AprilS, 1991; 5. The owner shall obtain the matching right-of-way for Shipp Drive and provide it to the Board in an acceptable format prior to recording the final plat for Tract 3019-Ai 6. The Final Plat for tract 3019-A including the dedication shall be properly executed and/or sanctioned by all parties having any recorded title interest in the land being subdivided and included on this subdivision; 7. The owner/subdivider shall obtain a revised report from the Arizona Department of Water Resources, indicating that the water supply has been found to be adequate to meet the needs of this subdivision prior to recording the final plat; 8. The cost estimate, in addition to the assurance, shall be revised to reflect the conditions set forth by Board of Supervisors Resolution No. 91-126. This resolution approved the abandonment of a portion of Avra Road, contingent upon construction of a brick wall barrier along the rear lot lines of lots 19, 21 & 22 of Block 5. Furthermore, the cost estimate and the corresponding assurance shall reflect any additional cost stipulated by the Mohave County Public Works Department for drainage improvements. 9. The Board of Supervisors Resolution of Abandonment 91- 126 shall be recorded and referenced on this map to be recorded. 10. Drainage parcels necessary to carry flood water through this tract from Highway 68 will be included as a part of this map. 11. An assurance and/or surety shall be provided in the amount of the approved cost estimate for all required site improvements; 12. The balance of 1990 taxes owing on all of the parcels involved with this tract shall be paid in full prior to this Final Plat's recordation. 13. Two copies of a preliminary title report dated and issued by a title insurance company within the preceding (30) days shall be submitted or a revised Policy of Title Insurance, dated within the preceding .... .~"~... Resol~n No. 91-133 . Page 6 PAGE 6 OF 6 BK 1883 PG 876 (FEE~91-21455) thirty (30) working days, showing accurate property description coinciding to that shown on the map; 14. The Articles of Incorporation, forming the property owner's association, shall be submitted prior to the Final Plat recordation. 15. A final signed copy of the CC&R' s shall be submitted with all other pertinent recordation documents. 16. Each page of the Final Plat shall be signed and sealed by the engineer of record. 17. Rezoning resolution 88-150 proposed rezoning for all of tract 3019. The recording of this tract 3019-A covers only a portion of the original zoning action; Therefore, only those lots included in tract 3019-A being herein recorded are rezoned by this action. NOW THEREFORE BE IT FURTHER RESOLVED, upon receipt of, or evidence that these conditions have been met, together with the executed mylars and appropriate recording fees, the Director of Planning and Zoning will obtain the necessary signatures from the County Departments and officials and cause the final plat to be recorded, and NOW THEREFORE BE IT FURTHER RESOLVED, that notice of hearing has been met and published throughout this subdivision process and the public was afforded notice of this final action through advertisement of the Board of Supervisors' meeting for this date.
