PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 HC RESOLUTION NO. 91-126 A RESOLUTION SETTING FORTH CONDITIONAL APPROVAL OF A REQUEST TO ABANDON A PORTION OF THE ROADWAY AND UTILITY EASEMENT KNOWN AS AVRA ROAD, LOCATED WITHIN AZTEC JUNCTION, TRACT 3019, IN SECTION 10, TOWNSHIP 21 NORTH, RANGE 18 WEST, LOCATED IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held April 1, 1991 a public hearing was conducted to determine whether approval should be granted to Aztec Junction, Inc., Jim Kuden, owner, Escondido, California, for abandonment of a portion of the roadway and utility easement known as Avra Road located within Aztec Junction, Tract 3019, in Section 10, Township 21 North, Range 18 West, located at the intersection of Avra Road and Shipp Drive extending north 1180 feet, located in the Golden Valley area, and WHEREAS, this petition for abandonment is being requested in order to accommodate the design of this proposed subdivision. An abandonment of two thirty (30') foot roadway and public utility easements on the east and west halves of the northerly extension of Avra Road, as it heads north approximately 1180 feet from Shipp Drive, is necessary before the Final subdivision plat can be recorded. The abandonment of this easement will not adversely affect the traffic circulation in the area. The additional sixty - . . . Resolution No. 91-126 PAGE BK Page 2 2 OF 3 1883 PG 847 CFEE~91-21448) (60) feet created by this abandonment will enable the developer to utilize his property to its maximum potential, and WHEREAS, it should be noted that the northwestern most portion of this abandonment is under separate ownership. Consequently, the applicant has submitted written consent from this property owner, granting approval of the abandonment of his property. As provided by Mohave County Subdivision Regulation 6.9-3, the applicant has provided a correct petition for abandonment, and WHEREAS, a public hearing before the Mohave County Planning and -Zoning Commission on April 10, 1991 did generate a recommendation of approval of this abandonment with the following conditions noted: 1. Compliance with the resolution preliminary plan for this tract. approving the 2. Lots 19, 21, & 22 of Block 5 shall be required to construct a physical barrier, to be determined by the Planning and Zoning Director, along that portion of this abandonment which is contiguous to the southeast lots. 3. This abandonment will be contingent upon recordation of the final plat for Aztec Junction, Tract 3019-A. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on April 14 and 21, 1991, and posted .. ,'to .. . . Resolution No. 91-126 Page 3 PAGE 3 OF 3 BK 1883 PG 848 (FEE~91-21448) April 11, 1991 as required by the Arizona Revised Statutes and the Mohave County zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 1, 1991 approved this abandonment request as recommended by the Mohave County Planning and zoning Commission, subject to the condition outlined herein.
