PAGE 1 OF 4 MOHAVE COUNTY BOARD OF SUPERVISORS RECoRDIHGFEE 0.00 HC RESOLUTION NO. 91-125 A RESOLUTION SETTING FORTH THE REZONING OF A PORTION OF S~ N~ SW~ NW~ AND S~ SW~ NW~ SECTION 22, TOWNSHIP 16 NORTH, RANGE 13 WEST, FROM: A (GENERAL) ZONE, PROPOSED TO BE: A-R/4A (AGRICULTURAL RESIDENTIAL/FOUR ACRE MINIMUM LOT SIZE) AND A-R/2A (AGRICULTURAL RESIDENTIAL/TWO ACRE MINIMUM LOT SIZE) ZONES, LOCATED IN THE WIKIEUP AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 1, 1991, a public hearing was conducted to determine whether approval should be granted to M D. and Joy Lange of Wikieup Arizona, for a rezoning from existing A (General) zone to A-R/4A (Agricultural Residential/Four Acre Minimum Lot Size) and A-R/2A (Agricultural Residential/TwO Acre Minimum Lot Size) zones, located one-half (.5) mile north of Chicken Springs Road and 400 feet west of Highway 93, in the Wikieup area, and WHEREAS, Section 22 is located approximately 30 miles south of the Highway 93 and 1-40 junction east of Kingman. The subject property is located approximately .25 miles south of the "north border" of Wikieup and is accessed from Highway 93 via a thirty (30') foot ingress/egress leading to the north portion of this property, and , .. . . Resolution No. 91-125 Page 2 PAGE 2 OF 4 BK 1883 PG 843 CFEEt91-21447) WHEREAS, review of floodplain map :/f040058-2913B indicates this area to be outside a designated floodplain. Surrounding land uses consist of a mixture of commercial and residential uses to the north, east and south with vacant land to the west. The applicant desires to split this property into two parcels with an easement to the lower parcel on the east side of the north parcel. The north parcel will be approximately 2+ and the south parcel approximately 4+ acres, and WHEREAS, this request has no area plan which specifically addresses land use designations, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on April 10, 1991, the Commission recommended APPROVAL of the requested zone change contingent upon the following conditions: 1. The southern parcel be zoned A-R/4A (Agricultural- Residential/Four Acre Minimum Lot Size) and the northern parcel be zoned A-R/2A (Agricultural- Residential/Two Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The establishment of a minimum lot size based on the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access. 5. The southern parcel shall meet or exceed four (4) acre and the northern parcel meet or exceed two (2) acres exclusive of road easements. , ~ ....J . . That the Board of Supervisors accept the dedication of a thirty (30') foot road right-of-way and eight (8') foot PUE as they are contiguous to this property's eastern boundary beginning at the northeast corner of this property and extending south with the exact southern dimension to be determined by parcel plat to ensure access to the southern parcel. In addition, the abandonment of the existing thirty (30' ) foot ingress/egress to be replaced by the dedication of a thirty (30') foot road right-of-way. This shall be approved through the recording of the resolution authorizing this zone change, and that the dedication statement and dedication be shown on the Parcel Plat. 8. The rezone shall not become effective for thirty (30) days after final approval of the classification by the Board of Supervisors, 31, 1991, as per ARS 11-829E. at least change in being May 9. I f these conditions are not met wi thin one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on April 14 1991, and posted April 12, 1991 as required by Arizona Revised Statutes, and the Mohave County zoning Regulations, and ~ ~.. .,J . . Resolution No. 91-125 Page 4 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Wednesday, May 1, 1991 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
