I WHICH REQUIRES A TWENTY ( 20 ') FOOT COMBINED SIDE YARD SETBACK BETWEEN STRUCTURES IN A MOBILE HOME PARK, BEING EL RODEO VILLAS MOBILE HOME PARK, BEING A PORTION OF NW~ SECTION 25, TOWNSHIP 19 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held March 4, 1991 a public hearing was conducted to consider approval of a petition of exception from Section 27-1 which requires a twenty (20') foot combined side yard setback between structures in a mobile home park. This request is for nineteen (19') feet for certain lots. El Rodeo Villas Mobile Home Park, being a portion of NW~ Section 25, Township 19 North, Range 22 West, is located approximately 1.25 miles east of Highway 95 on the south side of El Rodeo Road in the South Mohave Valley area, and WHEREAS, the plans for El Rodeo Villas were recently approved at the December 12, 1990 P&Z meeting. The applicant is seeking a petition of exception from Zoning Regulation 27.I.2.d.1 which requires a twenty (20 f) foot combined side yard setback between structures in a mobile home park. The applicant desires a modification to the typical site plan which would provide for a garage rather than a standard driveway. The addition of this .... . .. . . 2 OF 3 1883 PG 832 (FEE~91-21444) Page 2 Resolution No. 91-122 provision decreases the required side yard setback from twenty (20') feet to nineteen (19') feet. This petition affects the lots which are fifty-four (54') in width of which is a majority of the 74 total lots in this park, and WHEREAS, the Commission felt that the loss of one foot of side yard setback in return for the improved amenity and quality of this mobile home park is a valid argument for this petition of exception and recommend APPROVAL contingent upon the following conditions: 1. Resubmittal of site plans indicating the addition of a new typical pad detail for the fifty-four (54') foot wide lots. 2. This petition does not affect the fifty-five (55') foot and wider lots. Lots wider than fifty-four (54') feet must retain a combined twenty (20') foot side yard setback. 3. This petition of exception does not affect the mandatory five (5') foot side yard building setback or any other required setbacks. 4. Water and sewer line locations must be changed so lines are not underneath a structure. .New plans must be submitted which reflect the change. 5. If these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. .. .. . . Resolution No. 91-122 Page 3 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Wednesday, May 1, 1991 approved this petition of exception as recommended by the Commission and outlined herein.
