RESOLUTION NO. 91-107
A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT TO
PROVIDE FOR A BULK FUEL (PROPANE) STORAGE TANK IN AN A-D (AIRPORT
DEVELOPMENT) ZONE, LOCATED ON LOT IV-S, KINGMAN AIRPORT
INDUSTRIAL CENTER, SECTION 26, TOWNSHIP 22 NORTH, RANGE 16 WEST,
LOCATED IN THE KINGMAN AREA, MOHAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held March 4, 1991 a public hearing was conducted
to determine whether approval should be granted to AMERIGAS of
Tucson, Arizona for a Zoning Use Permit to provide for a bulk
fuel (propane) storage tank in an A-D (Airport Development) zone,
located on Lot IV-S, Kingman Airport Industrial Center, Section
26, Township 22 North, Range 16 West, occupying the northwest
corner of Interstate Way West and Mohave Airport Drive
intersection, located in the Kingman area, and
WHEREAS, Section 26 is located approximately 4.5 miles north
of the 1-40 and Andy Devine Avenue junction and includes a
portion of the Kingman City Airport. This parcel can be accessed
from Highway 66 ,via Industrial Parkway, east to Industrial
Boulevard, thence north to Mohave Airport Drive, thence east to
the southwest corner of Mohave Airport Drive and Interstate Way
West, and

WHEREAS, current requirements within Section 13.1 of the
Mohave County Zoning Regulations states the storage of flammable
gases may be permitted within an A-D zone upon the approval and
issuance of a zoning use permit.
This parcel is currently the
site of Schwans Ice Cream sales/distribution center. The
proposed propane tank will be for the fueling of the delivery
truck refrigeration units.
Surrounding uses consist of some
vacant land and commercial/manufacturing uses. The Planning and
Zoning Commission has received no indications of opposition from
the Airport Authority and the local fire agency has given
tentative approval for the preliminaries of the gas installation,
and
WHEREAS, a public hearing before the Mohave County Planning
and Zoning Commission on March 13,
1991 did generate a
recommendation of conditional approval of the Zoning Use Permit
(ZUP) with the following conditions noted:
1. That Zoning/Building permit(s) be obtained.
2. Erection of a buffer/protective wall meeting current
regulations and code specifications.
3. Approval of appropriate fire agencies of plans for
installation and operation of the storage tank.
4. If construction or use has not commenced within one (1)
year of Board approval of the Zoning Use Permit or if
the use has been discontinued for six (6) months, then
approval shall terminate at that date.
5. This Zoning Use Permit is subject to revocation upon
sixty (60) days notification by the Board of
Supervisors, if in the opinion of the Commission and
Board the continued use of the property would be
contrary to the public health, safety, and welfare.

WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona on March 17, 1991, and posted March 15,
1991 as required by the Arizona Revised Statutes and the Mohave
County Zoning Regulations, and
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, April 1, 1991 approved this
Zoning Use Permit as recommended by the Mohave County Planning
and Zoning Commission, subject to the conditions outlined herein.
