RESOLUTION NO. 91-106 A RESOLUTION SETTING FORTH APPROVAL OF A REQUEST FOR AN EXTENSION OF TIME FOR COMPLIANCE OF THE CONDITIONAL ZONE CHANGE FOR LOT 13, BLOCK I, GOLDEN SAGE RANCHOS #56, PER RESOLUTION NO. 90-48, LOCATED IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held April 1, 1991 a public hearing was conducted to consider approval of a request for an extension of time for compliance of the conditional zone change for Lot 13, Block I, Golden Sage Ranchos #56, per Resolution No. 90-48, and WHEREAS, Golden Sage Ranchos is located approximately .25 miles from the Highway 68 and 93 junction and is bisected by Highway 68. The subject property fronts on the south side of Highway 68 approximately 215 feet east of Tooman Road. This site is within the recently designated commercial land use for this section. At this time there are no utilities or improvements in this section south of Highway 68, and WHEREAS, the. applicant applied for C-2H zoning which was conditionally approved in February, 1990. The applicant has indicated to staff his reasoning for requesting an extension is the difficulty in getting necessary utilities extended to his property in addition to economic factors which would allow him to '" .~... . Resolution No. 9~06 . Page 2 incur the necessary expenses for needed infrastructure. The applicant has requested a two year extension. Proposed regulations by the planning consultant would allow for a "rebate" to a developer for improvements utilized by other developers, therefore, the applicant may be better able to incur the necessary costs to improve his site, and WHEREAS, the Planning & Zoning Commission at their meeting of March 13, 1991 recommended, by unanimous vote, approval of an extension of time to February 5, 1992, for the applicant to meet the conditions of Resolution 90-48 with the following additional conditions: 1. The applicant supply proof of due diligence in his continuing efforts to meet the conditions set forth in Resolution 90-48. 2. If these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 1, 1991 approved this extension of time to February 5, 1992 as recommended by the Commission and outlined herein.
