RESOLUTION NO. 91-105 A RESOLUTION SETTING FORTH THE REZONING OF PARCEL 71, BEING THE NE~ NW~ SECTION 17, TOWNSHIP 21 NORTH, RANGE 18 WEST, TO BE KNOWN AND SUBDIVIDED AS FRIENDLY GOLDEN VALLEY, TRACT 3033, FROM: A- R/I0A (AGRICULTURAL RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: (S-D)R (SPECIAL DEVELOPMENT/RESIDENTIAL) ZONE, LOCATED IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 3, 1991, a public hearing was conducted to determine whether approval should be granted to Friendly Golden valley I, an Arizona Limited Partnership, Los Angeles California, for a rezoning from existing A-R/I0A (Agricultural Residential/Ten Acre Minimum Lot Size) zone to (S- D)R (Special Development Residential) zone, located in the Golden Valley area, and WHEREAS, Section 17 is located approximately five and one- half (5.5) miles west of the junction of Highway 93 & 68 and is approximately one-half (.5) mile south of Highway 68. Access to the project will be provided via Highway 68 to Colorado Road, then south to Shipp Drive, then east to the southwest corner of San Pedro Road and Shipp Drive, and WHEREAS, the topography of the project site is relatively flat. However, the northwesterly portion of the site is within a " Resolution No. ~05 . Page 2 Zone A Flood Hazard zone. The subdivision plan includes a 125' wide drainage way to contain the anticipated flow. This project is bordered on the east and south by Rancho Verde (a one acre subdivision), on the north by state land and on the west by privately owned, unsubdivided, property. The parcel is currently vacant, undeveloped land with an A-R (Agricultural-Residential) zoning designation. The developer is requesting a zone change to SD/R (Special Development/ Residential). The proposed lots will have an minimum lot size of 9,000 square feet and an average of approximately 10,000 square feet. Also, three larger parcels are proposed for recreation, drainage and storage purposes, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on March 13, 1991 did generate a recommendation of APPROVAL of a modification to the requested zone change contingent upon the following conditions: 1. The zoning for this development be (S-D) R-l (Special Development/Single Family Residential) zone, and areas set aside for homes only development be called out and enforced through the subdivisions CC&R's. This in no way obligates the County to enforce the CC&R's through issuance of building permits. 2. That the ZONING PLAN be approved for a (S-D)R-1/9M (Special Development/Single Family Residential/Nine Thousand Square Foot Minimum Lot Size) zone in accordance with Section 19 of the Mohave County zoning Regulations. 3. The owner accepts that whenever a "SD" zone is granted, each phase of stage of development of building proposals shall be submitted to the planning staff, to be evaluated and compared with the approved zoning plan before any permits may be granted. 6. Any significant change (as determined by the Planning Director - appealable to the Planning Commission) in the approved zoning plan shall require a rehearing on the change before the Commission, with a final determination to be made by the Board. 7. Staff will maintain the most current approved ZONING PLAN on file in the master zoning folder for reviews. 8. The use of this property may not be changed by the owner/developer or subsequent owners as it is approved unless subsequently approved by the Board in accordance with Arizona Statutes Annotated, Title II, Chapter 6, Section 11-832. 9. The SD zoning map must be presented to Staff prior to Board of Supervisors cut off date for submittal of packet info to Board of Supervisors meeting that meets the following conditions, for whatever Board of Supervisors agenda the owner/developer wishes to be heard by the Board of Supervisors for approval of the final plat for this subdivision. 10. Minimum setbacks shall conform to current standard R-1 zoning specifications. 11. The engineer for the project has informed staff that Parcel B is to be designated for storage uses by the residents of this development. Therefore, a site/ improvement plan shall be submitted and approved for Parcel B prior to recordation of the final plat. 12. " ., Resolution No. ~~105 "---" -~' Page 4 WHEREAS, Condition 9 having been met by submittal of an S-D Plan on April 26, 1991 and subsequent approval of said S-D Plan, the Planning and Zoning Commission is forwarding this matter for consideration by the Board of Supervisors at the June 3, 1991 meeting, and WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on March 17, 1991, and posted March 19, 1991 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 3, 1991 approved this change in zoning as recommended by the Mohave County Planning and Zoning COllURission and outlined herein.
