PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE f\/ c.- RESOLUTION NO. 91-99 A RESOLUTION SETTING FORTH CONDIT~ONAL APPROVAL OF A REQUEST TO ABANDON THE EAST TWENTY (20') FEET AND THE WEST TWENTY (20') FEET OF THE ONE . HUNDRED (100') FOOT ROADWAY EASEMENT, KNOWN AS MOBILE DRIVE, IN SECTION 4, TOWNSHIP 21 NORTH, RANGE 18 WEST, LOCATED IN THE GOLDEN VALLEY AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held April 1, 1991 a public hearing was conducted to determine whether approval should be granted to Lee Roy Ollar of Kingman, Arizona, for abandonment of the east twenty (20') feet and the west twenty (20') feet of the one hundred (100') foot roadway easement, known as Mobile Drive, which runs north- south from Agua Fria Drive to Chino Drive in Section 4, Township 21 North, Range 18 West, located in the Golden Valley area, and WHEREAS, Section 4 is located approximately five (5) miles west of the Highway 68/93 junction and approximately .5 miles north of Highway 68. Burro Drive is the half section road for this section and Mobile Drive is a quarter section road. Under the Public Works hierarchy a half section road's suggested width is seventy (70') feet and a quarter section road is set at Sixty (60') feet. The applicant has indicated to the Conunission the primary purpose for this abandonm<;lnt is to take the requisite acreage needed for the roadways off the property owners taxes and -==-=-~=. . -- ..,._~- ~~--, ==-=-...=, . ~ ~esolution NO.~9 . The Board has done this on an individual basis on certain zoning cases where utilities were not affected, and WHEREAS, at the November 7, 1990 meeting the Commission recommended denial of this proposed abandonment based upon the reasoning that Citizens Utilities and Valley Pioneer Water Company have stated that their facilities would be on private land if this abandonment is approved. The applicant requested the item be tabled until an agreement could be reached with the affected utilities, and WHEREAS, the Planning and Zoning Commission has since received letters from the affected utilities that an abandonment would be agreeable if the reverted roadway easement were replaced by an equal width of public utility easement, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on March 13, 1991 did generate a recommendation of approval of this abandonment with the following conditions noted: 1. That the abandoned roadway easement be replaced by a PUE of equal dimension and said easement shall not be fenced without approval from affected utilities. 2. Any parcel plats processed (current or future submittals) by this department having frontage on this roadway be modified to reflect this action. 3. A forty (40') foot building setback line along Mobile Drive shall be established from the front property lines. 4. Future requests of this nature be held until after adoption of the Mohave County plan. ,.,. '~ ... ..,1- * Resolution No. ~9 . PAGE 3 OF BK 1871 PG Page 3 3 83 (FEE~91-15547) WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on March 17 and 24, 1991, and posted March 15, 1991 as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 1, 1991 approved this abandonment request as recommended by the Mohave County Planning and Zoning Commission, subject to the condition outlined herein.
