A RESOLUTION SETTING FORTH THE REZONING OF THE N~ SE~ NE~ SW~
SECTION 25, TOWNSHIP 19 NORTH, RANGE 22 WEST, TO BE KNOWN AND
SUBDIVIDED AS PINE RIVER ESTATES, TRACT 4128, FROM: A-R
(AGRICULTURAL RESIDENTIAL) ZONE, PROPOSED TO BE: R-O/lOM (SINGLE
FAMILY RESIDENTIAL/MOBILE HOMES PROHIBITED/TEN THOUSAND SQUARE
FOOT MINIMUM LOT SIZE) ZONE, LOCATED IN THE SOUTH MOHAVE VALLEY
AREA, MOHAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on April 1, 1991, a public hearing was
conducted to determine whether approval should be granted to
James Athanas of Las Vegas, Nevada for a rezoning from existing
A-R (Agricultural Residential) zone to R-O/I0M (Single Family
Residential/Mobile Homes prohibited/Ten Thousand Square Foot
Minimum Lot Size) zone, located in the South Mohave Valley area,
and
WHEREAS, this proposed subdivision is located on a five (5)
acre parcel which is located in a portion of the NE~ SW~ of
Section 25, Township 19 North, Range 22 West.
This subdivision
is accessed from, Highway 95 via Hammer Lane, then east
approximately 1.75 miles to Van Mouwerik, then south one quarter
mile to the northwest corner of this parcel, and

WHEREAS, the proposed development is bordered on the North
and West by the proposed subdivision Sun Desert Estates, Tract
4121, to the South by unsubdivided land and on the East by the
proposed subdivision Charisma, Tract 4109.
The project site is
currently vacant and is zoned A-R (Agricultural-Residential).
These projects are located on the western alluvial slope of the
Black Mountains and are subject to flash flooding and sheet flow
runoff, and
WHEREAS, the development consists of seventeen (17) lots for
homes only zoning.
The minimum lot size being proposed is
approximately ten thousand (10,000) square feet with the maximum
lot size being eleven thousand two hundred fifty (11,250) square
feet, and
WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on March 13, 1991, and upon review
of the preliminary plat, the Commission felt the standard R-O
zoning may not be appropriate for this subdivision and did
recommend a modification to the requested zone change to R-O/I0M
(Single Family Re~idential/Mobile Homes prohibited/Ten Thousand
Square Foot Minimum Lot Size) and did recommend APPROVAL of this
amended zone change contingent upon the following conditions:

2. The applicant comply with all applicable provisions of
Sections 25, 26, 27, and 31 of the Mohave County Zoning
Regulations.
3. Special side front yard setbacks of fifteen (15') feet
apply to lots 1 & 17, side fronting on Van Mouwerick.
4. The rezone shall become effective upon the recordation
of the Final Plat.
WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona, on March 17, 1991, and posted March 19,
1991 as required by Arizona Revised Statutes, and the Mohave
County Zoning Regulations, and
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, April 1, 1991 approved this
change in zoning as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
