PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He RESOLUTION NO. 91-198 A RESOLUTION SETTING FORTH APPROVAL OF A PETITION OF EXCEPTION FOR A CHANGE OF STREET SECTION FOR SHIPP ESTATES III, TRACT 3026, LOCATED IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the special meeting of the Mohave County Board of Supervisors held July 22, 1991 a public hearing was conducted to consider approval of a petition of exception for a change of street section for Shipp Estates III, Tract 3026, located in the Golden Valley area, and WHEREAS, the owners/developers of this tract are Desert Investment Properties, an Arizona General Partnership and B.P.J.&S., a Limited Partnership, Kingman, Arizona. The Engineer responsible for the preparation of the drainage report and design of this subdivision is John A. Proffit, P.E., Mohave Engineering Associates, Inc., and WHEREAS, this proposed subdivision is located approximately seven (7) miles west of the junction of Highways 93 and 68 and is . approximately one-half (1/2) mile south of Highway 68 on the northwesterly intersection of Shipp Drive and Teddy Roosevelt' Road. This project fronts Shipp Drive for approximately three- quarters (3/4) of a mile to Davis Road and fronts Teddy Roosevelt . Resolution No. 91-~ . PAGE BK Page 2 2 OF 3 1922 PG 192 (FEE~91-39~07) Road for approximately one-quarter (1/4) mile to Brook Drive, and WHEREAS, the preliminary plan depicts ninety (90) acres subdivided into 280 lots. These lots will have a minimum size of 9,000 square feet and a maximum size of 14,000 square feet, and WHEREAS, the applicant is requesting a change in the roadway and street sections for this project. The Preliminary Plan for Shipp Estates III, T-ract 3026 was approved via Board of Supervisors Resolution 90-119 in May of 1990. The applicant's engineer has submitted a drawing which depicts a street section that complies with the proposed minimum street standards for Urban Roadway Design for Mohave County. It is the intent of the developer to complete all improvements of Phase I prior to recording the Final Plat. Furthermore, the developer is requesting, that the petition of exception apply to all of the phases in the projects evaluated by the Planning and zoning Commission and Board of Supervisors, and WHEREAS, Petition of Exception was submitted for the following exception: A. Streets less than standard width. This petition is submitted as a request that the Planning and Zoning Commission recommend to the Board of Supervisors the granting of an exception from the Subdivision Regulations as outlined in Article 1.13 for - the following reasons: 1. The granting of this petition will not be detrimental to the public welfare or injurious to other adjacent properties because: .. Resolution No. 91A1tB . Page 3 PAGE 3 OF 3 BK 1922 PG 193 (FEE~91-39407) a. The finished street section will very nearly match the standard section required by Mohave County so that there will be no visual effect. The proposed streets will serve no other than the residents and guest of the subdivision. Further, utility easements B feet in width are proposed on either side of the street right- of-way so that residents will be provided with the same services as though the streets meet the requirements. A copy of the proposed street section is attached. 2. This request will not nullify the intent of purpose of the Master Plan of the County or other regulations because the proposed exception will not effect anything outside of the subject project. A letter from Public Works on July 1, 1991 gave the following comment:' We have reviewed the proposed street sections in the request letter dated July 1, 1991 for Tract 3026 (Shipp Estates III) and find the" request substantially conforms to our newly proposed standards for Urban Street Design. We do not foresee a problem with supporting the petition request and its continued processing. WHEREAS, the Commission recommends APPROVAL of the Petition of Exceptions based on the aforementioned Public Works approval. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their special meeting on Monday, July 22, 1991 approved this petition of exception as recommended by the Commission and outlined herein.
