PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He RESOLUTION NO. 91-197 A RESOLUTION SETTING FORTH APPROVAL OF A PETITION OF EXCEPTION FOR LOS LAGOS, PHASE II TRACT 4096-B, EXCLUDING TRACT 4096-A, BEING A SUBDIVISION OF A PORTION OF SECTION 1, TOWNSHIP 18 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MORAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the s~ecia1 meeting of the Mohave County Board of Supervisors held July 22, 1991 a public hearing was conducted to consider approval of a petition of exception for Los Lagos, Phase II, Tract 4096-B, located in the South Mohave Valley area, and WHEREAS, the owner of this project is Los Lagos Limited Partnership of Santa Ana, California. The engineer of record is William E. Miller, P.E. of Holland West, Inc., Englewood, Colorado, and WHEREAS, the project site is located approximately one mile east of Highway 95 on Boundary Cone Road, and WHEREAS, this project has received approval for the Revised Preliminary Subdivision Plan, 4096, Phase II, Tract No. Resolution 91-182, on July 1, 1991. Other Petitions of Exception were processed with the Revised Preliminary Plan, and .. (1 l. " J ~ . PA' 2 OF 3 BK 1922 PG 189 (FEE~91-39~06) Page 2 Resolution No. 91-197 WHEREAS, Petition of Exception was submitted for private interior streets, except Bison Road which will remain public right-of-way, and WHEREAS, this request for a petition of exception is submitted as there are special circumstances or conditions which affect the property, and granting of the exception will not be detrimental to the public welfare or injurious to other property in the area in which said property is situated, and it will not have the effect of nullifying the intent and purpose of the Master Plan of the County or of the Mohave County Subdivision Regulations, and WHEREAS, the granting of a petition for private streets will not be detrimental to the public welfare or injurious to other adjacent properties because. these private streets will be built in accordance with regulations as set forth in Section 6.4 Roadways General, of Subdivision and Road Maintenance Regulations for Mohave County, and WHEREAS, most of the streets in Tract 4096-A are private streets administered under Vista Bella Corporation. The administration of private streets of units under this amended tract will come under said corporation, and .......- t . Resolution No. 91-197 . :3 OF :3 BK 1922 PG 190 (FEE~91-39~06) Page 3 WHEREAS, granting of this Petition necessitates that the property owners organization of Vista Bella annex this area into their area of jurisdiction and assume maintenance of the roads, and WHEREAS, the Commission recommends APPROVAL of the Petition of Exceptions based on the aforementioned justifications. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their special meeting on Monday, July 22, 1991 approved this petition of exception as recommended by the Commission and outlined herein.
