A RESOLUTION SETTING FORTH APPROVAL OF A FINAL SUBDIVISION PLAN
FOR LOS LAGOS, PHASE II, TRACT 4096-B, A PORTION OF A REVISED
PRELIMINARY PLAT SUBDIVISION WITHIN SECTION 1, TOWNSHIP 18 NORTH,
RANGE 22 WEST, GILA & SALT RIVER BASE & MERIDIAN, LOCATED IN THE
SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on August 5, 1991, a public hearing was
conducted to determine the final subdivision plan for LOS LAGOS,
Phase II, Tract 4096-B, located in the South Mohave Valley Area,
and
WHEREAS, the owner/subdivider of this tract is Los Lagos
Limited Partnership, Newport Beach, California. The engineer
responsible for the preparation of the drainage report and design
of this subdivision is William E. Miller, P.E., Holland West,
Inc., Englewood, Colorado and Bullhead City, Arizona, and
WHEREAS, the project site is located approximately one (1)
mile east of Highway 95 on the north side of Boundary Cone Road.
The approved revised preliminary subdivision plan depicts 263.12
acres subdivided into 593 residential lots and a golf course,
however, in this phase of the project the developer proposes to
develop the golf course, drainage easements, public utility

easements and right-of-way parcels which consist of 131.65 acres,
more or less, and
WHEREAS, it is intended that all the parcels are to be zoned
SD/C-RE (Special Development/Commercial-Recreational) as approved
by the Board on February 5, 1990, Board of Supervisors Resolution
No. 90-36, and through a revised SD plan, and
WHEREAS, the adjoining property to the north are approved
final plans, Los Lagos, Tract No. 4096-A and proposed Sun Valley,
Tract No. 4064. To the east is Homes By Brown, Mountainside
Ranch, Tract No. 4106-A and B, and to the west and south are Fort
Mojave Indian Reservation land, and
WHEREAS, reviews have been received from the County
Engineer/Floodplain Administrator, Mohave Electric Cooperative,
Citizens Utilities Rural Company, Inc., Sorenson Sewer District,
Southwest Gas, the Fort Mojave Mesa Fire Department, the Mohave
Count,y Health Department" Bermuda Water COIl.lpany, Mohave Valley
Irrigation District and EI Paso Natural Gas Company, and
considered or incorporated into the evaluation of this tract, and
WHEREAS, the approval of this subdivision was based on the

understanding of the Commission and the Board of 'Supervisors that
the owner/subdivider will not be dedicating or constructing any
public rights-of-way; however, Parcel M is designated as a
private ingress and egress that will connect with the road system
in Los Lagos, Tract No. 4096-A and Boundary Cone Road;

and drainage related improvements will be made as recommended by
the design engineer in the submitted drainage report, and as
approved by the County Engineer;
existing boundary and parcel
boundaries will be staked and monumented in accordance with
Standard Specification No. 102; and as a condition of approval,
the owner/subdivider is responsible for the completion of these
site improvements and shall provide an assurance for all required
subdivision improvements in accordance with Article V of the
Subdivision Regulations~ and
WHEREAS, this tract is within a FEMA designated floodplain,
Zone A and C.
NOW THEREFORE BE IT RESOLVED, that the Board approves the
said final plan conditional to the following:
1. The developer will make the same commitments for
improvements in the prospectus to the State Real Estate
Commission as is required for approval of this tract by the
Board of Supervisors. A Copy of the final report to the
Real Estate Commission shall be submitted to the Planning
Department for file retention.
2. The owner/subdivider shall cause the drainage related
improvements to be completed as recommended by the project
engineer and outlined in the detailed drainage report and
approved by the County Engineer.
3. The owner/subdivider shall provide the requisite report
indicating that the water supply has been found to be
adequate to meet the needs of this subdivision prior to
recording the final plat.

4. The dedication statements shall reflect the granting to
the public the "Public Utility Easements and Drainage
Easements for their intended purpose".
5. Signed original of C.C.&R.'s, shall be submitted ready
for recording.

6. Property Owners Association or other corporate entity
shall be created for this tract, or annexed by an existing
corporate enti ty, for the parcels that are to be
administered by them. The recorded copy of Articles of
Incorporation shall be submitted to the Planning Department
for file retention.
7. The final plat for Los Lagos, Phase II, Tract No. 4096-
B, including the dedication will need to be properly
executed and/or ratified by all parties having any record
title interest in the land being subdivided and included
within this subdivision boundary.
NOW THEREFORE BE IT FURTHER RESOLVED, upon receipt of, or
evidence that these conditions have been met, together with the
executed mylars and appropriate recording fees, the Director of
Planning and zoning will obtain the necessary signatures from the
County Departments and officials and cause the final plat to be
recorded, and
THEREFORE BE IT FURTHER RESOLVED, that notice of hearing has
been met and published throughout this subdivision process and
the public was afforded notice of this final action through
advertisement of the Board of Supervisors' meeting for this date.
