A RESOLUTION SETTING FORTH THE REZONING OF LOTS 1, 2, 3, 39 & 40,
BLOCK 146, NEW KINGMAN ADDITION #10, TRACT 1103, FROM: C-2
(GENERAL COMMERCIAL) ZONE, PROPOSED TO BE: C-2t+ (HIGHWAY
COMMERCIAL) ZONE, LOCATED IN THE KINGMAN AREA, MOHAVE COUNTY,
ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on June 3, 1991, a public hearing was
conducted to determine whether approval should be granted to
Vince Steinhoff of Kingman, Arizona for a rezoning from existing
C-2 (General Commercial) zone to C-2H (Highway Commercial) zone,
occupying the northwest corner of Northern Avenue and North
Roosevelt Street, located in the Kingman area, and
WHEREAS, New Kingman Addition #10 is located approximately
2.5 miles north of the 1-40 and Stockton Hill Road junction. The
subject property is accessed from Stockton Hill Road via Northern
Avenue thence east 1.25 miles to the northwest corner of Northern
Avenue and North Roosevelt Street, and
WHEREAS, review of floodplain map #040058-2165C indicates
this lot to be clear of a designated floodplain.
Surrounding
land uses consist of occupied C-2 uses to the west, northwest and
east with vacant R-M zoning to the south across Northern Avenue.

Lots 39 & 40 front Northern Avenue while lots 1-3 front Butler
Avenue.
The applicant is seeking this zone change to allow for
the construction of a storage freezer on lot 1 to store ice from
the ice plant located on lots 39 & 40.
The applicant sells ice
wholesale and the storage is needed to provide a sufficient
supply for local businesses The applicant will use the remainder
of the lots for open lot storage of related materials. Access to
the storage facility is proposed to be from Butler Avenue, and
WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on May 8, 1991, the Commission
recommended APPROVAL of the requested zo~e change contingent upon
the following conditions:
1. The applicant comply with all applicable provisions of
Sections 25, 26, 27, & 31 of the Mohave County Zoning
Regulations. In addition to compliance with Ordinance
87-1 (Dark Sky Ordinance).
2. Submittal and recordation of a Parcel Plat prepared in
accordance with Article 3.16 of the Mohave County
Subdivision Regulations.
3. Lots 1, 2, 3, 39 & 40 be combined through an
abandonment and parcel plat procedure. (Individually
these lots have insufficient area for a C-2H zone and
therefore must be combined). The applicant must submit
an abandonment/reversion to acreage petition in order
to facilitate the processing of the parcel plat. All
utility companies with interest in the sixteen (16 ')
foot utility easement at the rear of the lots must give
concurrence for the parcel plat.
4. The establishment of a minimum lot size based on the
size of the combined parcels per the recorded Parcel
Plat.
5. The Parcel Plat shall show any surface drainage.

The zoning for these combined parcels be

7 . The applicant supply proof of hookup to an approved
communi ty water system and acceptable sewage disposal
facility.
8. Building/Zoning permit(s) shall be obtained.
9. The development shall have adequate parking facilities.
10. All paving (driveways and parking) be paved in
accordance with Mohave County Standard Specification
#171 or better, and that such paving be completed
within ninety (90) days of the certification of
occupancy granted the building.
11. Any open lot storage must be related to or be an
accessory to the primary business. The storage area
shall be covered with a dust-proof surface. If crushed
rock is used for the dust-proof surface then the soil
shall be maintained in a weed free condition.
12. Such storage shall be completely enclosed by a view-
obscuring fence which extends two (2') feet above the
highest item to be stored, with a minimum of six (6')
feet and a maximum of eight (8') feet in height. Such
a fence shall display no advertising.
13. That a buffer, in the form of a six (6') foot solid
wall shall be required along the western boundaries of
Lot 3 and 39 where permitted commercial uses for a C-2H
zone would abut less intensive commercial zoning.
Construction must be coordinated with pertinent
utilities as to location of PUE and placement of solid
wall.
14.
The rezone shall not become effective for
thirty (30) days after final approval of the
classification by the Board of Supervisors,
recording of the aforementioned parcel plat,

15. If these conditions are not met within one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the rezoning shall schedule a
public hearing to grant an extension, determine
compliance with the schedule for development or cause
the property to revert to its former zoning
classification in accordance with Arizona Revised
Statutes Annotated, Title 11, Chapter 6, 11-832.

WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona, on May 19, 1991, and posted May 17, 1991
as required by Arizona Revised Statutes, and the Mohave County
zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, June 3, 1991 approved this
change in zoning as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
