PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He RESOLUTION NO. 91-160 A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT TO ESTABLISH A MOBILE HOME AS A RESIDENCE IN A C-2 (GENERAL COMMERCIAL) ZONE, IN LOT 5, BLOCK 137, NEW KINGMAN ADDITION #9, TRACT 1102, LOCATED IN THE KINGMAN AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held June 3, 1991 a public hearing was conducted to determine whether approval should be granted to Joe & Joan Bettinger of Santa Ana, California, for a Zoning Use Permit to establish a residence in a C-2 (General Commercial) zone on Lot 5, Block 137, New Kingman Addition #9, Tract 1102, located on the south side of Neal Avenue approximately 320 feet west of Powell Avenue, in the Kingman area, and WHEREAS, New Kingman Addition #9 is located approximately 2.5 miles due north of the 1-40 and Highway 66 junction. The subject property is accessed from Highway 66 via Castle Rock Road north to Northern Avenue thence west .75 miles to North Melody Street thence north approximately 450 feet to Neal Avenue thence east approximately 500 feet on the south side of the street, and WHEREAS, review of floodplain map #040058-2165C indicates this lot to be within a designated floodplain. Surrounding land uses consist of a home to the south, vacant land to the west and .. . .GE 2 OF 3 1898 PG 744 (FEE~91-28347) Resolution No. 91-160 Page 2 north with two vacant lots between this lot and commercial uses to the east, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on May 8, 1991 did generate a recommendation of conditional approval of the Zoning Use Permit (ZUP) with the following conditions noted: 1. That zoning/Building permit(s) be obtained. 2. If construction or use has not commenced within one (1) year of Board approval of the Zoning Use Permit or if the use has been discontinued for six (6) months, then approval shall terminate at that date. 3. This Zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if in the opinion of the Commission and Board the continued use of the property would be contrary to the public health, safety, and welfare. 4. That the mobile home shall be used as a residence only and shall not be used in conjunction with the underlying C-2 (General Commercial) zoning. I f the underlying C-2 zoning were to be exercised by the owner of the property then a rehearing of this ZUP would be required. 5. The mobile home shall have an affixed HUD label. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on May 19, 1991, and posted May 17, 1991 as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations. ~ .. '"!' . ~GE 3 OF 3 ~ 1898 PG 745 (FEE~91-28347) Resolution No. 91-160 Page 3 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 3, 1991 approved this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission, subject to the conditions outlined herein.
