PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 HC RESOLUTION NO. 91-159 A RESOLUTION SETTING FORTH THE DENIAL OF A ZONING USE PERMIT TO ESTABLISH A RESIDENCE IN A C-1 (NEIGHBORHOOD COMMERCIAL) ZONE, ON LOT 21, BLOCK 230, NEW KINGMAN ADDITION #11, TRACT 1104, LOCATED IN THE KINGMAN AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 3, 1991, a public hearing was conducted to determine whether approval should be granted to John D. Vanderstaay of Kingman, Arizona for; a Zoning Use Permit to establish a residence in a C-1 (Neighborhood Commercial) zone, or if the Planning and Zoning Commission recommendation for DENIAL should be upheld. The request is located on the west side of North Sierra opposite Northfield Avenue, in the Kingman area, and WHEREAS, New Kingman Addition #9 is located approximately 3 miles due north of the 1-40 and Stockton Hill Road junction. The subject property is accessed from Stockton Hill Road via Northern Avenue thence east 300 feet to North Sierra Street thence north approximately .25 miles on the west side of the street opposite Northfield Avenue, and WHEREAS, review of floodplain map #040058-2165C indicates this lot to be clear of a designated floodplain. Surrounding land uses consist of homes to the southeast, a commercial ... . ~ -.... . . Resolution No. 91-159 Page 2 building 150 feet to the northwest and the remainder being vacant land. The east half of this block is C-1 and the west half which fronts Stockton Hill Road is C-2H separated by a thirty (30') foot alley running north to south. The Commission staff has received one opposition letter from an adjoining property, however it does not constitute a 20% protest in area or number, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on May, 1991 did generate a recommendation of DENIAL of this request based on the following: 1. Character of the immediate area is commercial. This lot backs onto C-2H zoning, having frontage on Stockton Hill Road, which has high potential for intense commercial development. 2. There are no existing residential uses on this block. 3. The immediate neighbors have indicated their opposition to this request but was not sufficient for a 20% protest. WHEREAS, the notice of hearing was published in the Mohave Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on May 19, 1991, and posted May 17, 1991, as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 3, 1991 denied this PAGE 2 OF 3 BK 1898 PG 741 (FEE~91-28346) - (. ~ . .
