PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He RESOLUTION NO. 91-155 A RESOLUTION SETTING FORTH THE REZONING OF LOT 69, DIAMANTE ACRES, SUNWARD HO RANCHES, SECTION 7, TOWNSHIP 22 NORTH, RANGE 16 WEST, FROM: A-R/10A (AGRICULTURAL RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-R/5A (AGRICULTURAL RESIDENTIAL FIVE ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE KINGMAN AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 3, 1991, a public hearing was conducted to determine whether approval should be granted to James & Mary Ellen Teeter of San Diego, California for a rezoning from existing A-R/10A (Agricultural Residential/Ten Acre Minimum Lot Size) zone to A-R/5A (Agricultural Residential/Five Acre Minimum Lot Size) zone, located on Calle Castano, 1880 feet ease of Cherum Road in the Kingman area, and WHEREAS, Section 7 is located approximately 3 miles north of the Butler area and east of Stockton Hill Road. The subject property is accessed from Stockton Hill Road via Cactus Wren Drive (approximately 4 miles north of Northern Avenue) east approximately 1.5 miles to Cherum Road thence north approximately .5 miles to Calle Castano thence east 1850 feet on the south side of the road, and , Resolution No. .55 ~ BK Page 2 2 OF 3 1898 PG 726 (FEE~91-283+2) WHEREAS, review of floodplain map #040058-2155B indicates a portion of this twenty (20) acre lot to be in a designated floodplain. This parcel is currently vacant. Surrounding land uses consist of mostly vacant land with some residential uses. A number of the surrounding parcels to the north are five acre parcels. properties to the other sides are twenty acre parcels The applicant desires to split this parcel into three, approximately 5 acre pieces, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 8, 1991, the Commission recommended APPROVAL of the requested zone change contingent upon the following conditions: 1. These parcels be zoned A-R/5A (Agricultural- Residential/Five Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The establishment of a minimum lot size based on the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access. 5. These parcels shall meet or exceed five (5) acre exclusive of road easements. 6. The parcel Plat shall show any surface drainage and FEMA designated flood zones. 7. That the Board of Supervisors accept the dedication of a thirty (30') foot right-of-way and eight ( 8') foot PUE as they are contiguous to the western property line of this parcel. In addition, twenty (20') radii at the intersection of the above mentioned roadway, an extension of Avenida Ramirez, and Calle Castano. In addition there shall be provisions made for a turn around at the terminus of this access in accordance wi th and meeting the standards set forth in Mohave County regulations. This shall be approved through the Resol~n No. 91-155 .E BK Page 3 3 OF 3 1898 PG 727 (FEE~91-28342) recording of the resolution authorizing this zone change, and that the dedication statement and dedication be shown on the Parcel Plat. 8. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors AND upon recordation of the parcel plat, as per ARS 11-829E. 9. I f these conditions are not met wi thin one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on May 19, 1991, and posted May 17, 1991 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 3, 1991 approved this change in zoning as recommended by the Mohave County Planning and zoning Commission and outlined herein.
