PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 Ne tffC1{Of\L~ RESOLUTION NO. 91-153 A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT TO ALLOW TEMPORARY OPEN LOT STORAGE OF HIGHWAY CONSTRUCTION EQUIPMENT IN A C-2 (GENERAL COMMERCIAL) ZONE, ON LOT 101, GATEWAY ACRES UNIT 10, SECTION 19, TOWNSHIP 25 NORTH, RANGE 19 WEST IN THE DOLAN SPRINGS AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held June 3, 1991 a public hearing was conducted to determine whether approval should be granted to Stephen Holley of Dolan Springs, Arizona, for a zoning Use Permit (ZUP) to allow temporary open lot storage of highway construction equipment in a C-2 (General Commercial) zone on Lot 101, Gateway Acres Unit 10, Section 19, Township 25 North, Range 19 West, occupying the northeast corner of Highway 93 and Pierce Ferry Road in the Dolan Springs area, and WHEREAS, the Pierce Ferry Road and Highway 93 junction is approximately 30 miles northwest of Kingman. The subject property is accessed via Pierce Ferry Road but has frontage on Highway 93 right-of-way. The property is currently occupied with a residence and commercial building~ The applicant has arrangements with ADOT to store construction vehicles and fuel on the property while expansion of Highway 93 is in progress. Resolution No. 91-153 Page 2 a ZUP was obtained to allow temporary open lot storage of heavy equipment, and WHEREAS, a public hearing before the Mohave County Planning and zoning Commission on May 8, 1991 did generate a recommendation of conditional approval of the Zoning Use Permit (ZUP) with the following conditions noted: 1. This permit shall be for a temporary permit for a one year period with provision for extensions of one year. 2. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. In addition to compliance with Ordinance 87-1 (Dark Sky Ordinance). 3. At the conclusion of ADOT Highway 93 N Project Number F-039-1-507 the applicant shall contact staff if ADOT wishes to use this parcel as storage of equipment for another project of similar nature and the applicant wishes to have this ZUP extend to cover the time frame of the additional project or subsequent projects. 4. At the expiration of this approval the property shall revert to original zoning and condition. 5. If construction or use has not commenced within one (1) year of Board approval of the Zoning Use Permit or if the use has been discontinued for six (6) months, then approval shall terminate at that date. 6. This Zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if in the opinion of the Commission and Board the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on May 19, 1991, and posted May 17, 1991 PAGE 2 OF 3 8K 1898 PG 719 (FEEt91-283~O) '\ ".! ..- . . Resolution No. 91-153 Page 3 as required by the Arizona Revised Statutes and the Mohave County zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 3, 1991 approved this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission, subject to the conditions outlined herein.
