PAGE 1 OF 4 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 Ne RESOLUTION NO. 91-149 A RESOLUTION SETTING FORTH THE REZONING OF LOTS 31-34, BERMUDA VILLAGE, BEING A PORTION OF SECTION 15, TOWNSHIP 17 NORTH, RANGE 22 WEST, FROM: C-2 (GENERAL COMMERCIAL) ZONE, PROPOSED TO BE: C- MO (COMMERCIAL MANUFACTURING/OPEN LOT STORAGE) ZONES, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 3, 1991, a public hearing was conducted to determine whether approval should be granted to David Hargus of Mohave Valley, Arizona for a rezoning from existing C-2 (General Commercial) zone to C-MO (Commercial Manufacturing/Open Lot Storage) zone, located on the east side of Bermuda Court approximately 210 feet south of village Drive in the South Mohave Valley area, and WHEREAS, Section 15 is located approximately 13 miles south of Bullhead City's southern limits and is immediately west of Barrackman Road. The subject property is accessed from Barrackman Road via Village Drive thence west approximately 150 feet to Bermuda Court thence south approximately 250 feet on the east side of the street, and WHEREAS, review of floodplain map #040058-2615C indicates this area to be in a minor designated flood zone. The property -#0 Resolution No. ~149 Page 2 . is currently vacant and surrounding land uses consist of commercially zoned properties on all sides with existing C-MO zoning to the south and north of these parcels. The applicant has indicated his intention to establish a car repair business on this location, and WHEREAS, this rezone request is in conformance with the South Mohave Area Plan for Bermuda Village in that this area was identified as commercial and consideration of changing to residential uses was not initiated, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 8, 1991, the Commission recommended APPROVAL of the requested zone change contingent upon the following conditions: 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. In addition to compliance with Ordinance 87-1 (Dark Sky Ordinance). 2 . The zoning for these combined parcels be C-MO (Commercial Manufacturing Open Lot Storage/Ten Thousand Square Foot Minimum Lot Size) zone. 3. Lots 31, 32, 33 & 34 be combined through an abandonment and parcel plat procedure. (Individually these lots have insufficient area for a C-MO zone and therefore must be combined). The applicant must submit an abandonment/reversion to acreage petition in order to facilitate the processing of the parcel plat. 4. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. (If the applicant desires to coordinate this requirement with the proposed abandonment actions of Bermuda Court he may do so if the procedure is acceptable to Mohave County.) 5. The establishment of a minimum lot size based on the size of the combined parcels per the recorded Parcel Plat. PAGE BK 2 OF 4 1898 PG 708 (FEEt91-28337) - .,"' Resolution~. 91-149 . Page 3 6. The Parcel Plat shall show any surface drainage. 7 . Any open lot storage must be related to or be an accessory to the primary business. 8. Such storage shall be completely enclosed by a view- obscuring fence which extends two (2') feet above the highest item to be stored, with a minimum of six (6') feet and a maximum of eight (8') feet in height. Such a fence shall display no advertising. 9. The applicant shall pave the driveway access and parking in accordance with Mohave County Standard Specification #171, or better. The storage area shall be covered with a dust-proof surface. If crushed rock is used for the dust-proof surface then the soil shall be maintained in a weed free condition. 10. The applicant shall obtain pertinent building permits. 11. The applicant supply proof of hookup to an approved community water system and sewage treatment facility. 12. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors, being July 3, 1991, as per ARS 11-829E. 13. If these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on May 19, 1991, and posted May 17, 1991 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. Page 4 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 3, 1991 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
