PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 NC RESOLUTION NO. 91-148 A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT TO ESTABLISH AN OFF PREMISE SIGN IN AN A-R (AGRICULTURAL RESIDENTIAL) ZONE LOCATED IN A PORTION OF THE N~ SE~ SECTION 22, TOWNSHIP 19 NORTH, RANGE 22 WEST, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held June 3, 1991 a public hearing was conducted to determine whether approval should be granted to Tom Flanagan, KUNZ AND COMPANY, San Bernardino, California, for a Zoning Use Permit (ZUP) to establish an off premise sign in an A-R (Agricultural Residential) zone, located in a portion of the N~ SE~ Section 22, Township 19 North, Range 22 West, opposite the corner of Highway 95 and Courtney Place, located in the South Mohave Valley area, and WHEREAS, Section 22 is located one (1) mile south of Bullhead City's southern border and has frontage on the west side of Highway 95. The south half and northwest quarter of this section are being proposed as a subdivision previously named Mohave Mesa (name to be changed to Rio Pointe). The proposed site is west of the Courtney place and Highway 95 intersection and setback sixty (60') feet from the Highway 95 centerline, and I l _) " Resolution No. .148 . Page 2 WHEREAS, surrounding land uses consist of the proposed Mohave Valley Mall subdivision to the north, vacant land to the west and south with Mohave Valley Business Park to the east across Highway 95 to the east. The applicant for this ZUP is proposing a 240 square foot sign similar in nature to other billboards in existence along Highway 95 south of Bullhead City. In addition there are only three other off premise sign within the mile between Camp Mohave and El Rodeo Roads. No specific contents for the sign has been proposed. The applicants request is in conformance to necessary regulations except the zoning. The specific site for this proposed sign is in a designated commercial area according to the area plan approved for this section and the recently submitted preliminary plat. Therefore, if the subdivision is approved, the site will be zoned commercial and meet the zoning aspect of the criteria necessary for an off premise sign, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on May did 8, 1991 generate a recommendation of conditional approval of the Zoning Use Permit (ZUP) with the following conditions noted: 1. This permit shall be for a one year period with provision for two consecutive extensions of one year each. If the proposed Rio Pointe subdivision and its accompanying commercial zoning is not in place at that time, this permit shall be void. 2. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. In addition to compliance with Ordinance 87-1 (Dark Sky Ordinance). The applicant shall cause the removal of the signage at the expiration of the permit. 4. If construction or use has not commenced within one (1) year of Board approval of the Zoning Use Permit or if the use has been discontinued for six (6) months, then approval shall terminate at that date. This Zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if in the opinion of the Commission and Board the continued use of the property would be contrary to the public health, safety, and welfare. 6. That appropriate zoning/building permits be obtained. 5 . WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on May 19, 1991, and posted May 17, 1991 as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 3, 1991 approved this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission, subject to the conditions outlined herein.
