A RESOLUTION SETTING FORTH THE REZONING OF LOTS 39 & 40, BLOCK
111, NEW KINGMAN ADDITION UNIT #8, TRACT ll01, FROM: C-2 (GENERAL
COMMERCIAL) ZONE, PROPOSED TO BE: (S-D)C-2H (SPECIAL
DEVELOPMENT /HIGHWAY COMMERCIAL) ZONE, LOCATED IN THE KINGMAN
AREA, MOHAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on May 1, 1991, a public hearing was
conducted to determine whether approval should be granted to
Edward R. Holman of Cucamonga, California for a rezoning from
existing C-2 (General Commercial) zone to (S-D) C-2H (Special
Development/Highway Commercial) zone, occupying the northwest
corner of Northfield Avenue and North Bank Street, in the Kingman
area, and
WHEREAS, New Kingman Addition #8 is located approximately
2.5 miles due north of the 1-40 and Highway 66 junction. The
subject property is accessed from Highway 66 via Castle Rock Road
north to Gordon Drive thence west 1 mile to North Bank Street
thence north approximately 1.25 miles to the northwest corner of
Northfield Avenue and Bank Street, and
WHEREAS, review of floodplain map #040058-2165C indicates
this lot is not in a designated floodplain.

uses consist of
vacant commercially zoned land to the south,
Margaritaville Restaurant to the east, a commercial building to
the north, residential uses 200 feet to the west and northwest,
and
WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on April 10, 1991, the Commission
recommended APPROVAL of the requested zone change contingent upon
the following conditions:
1. The applicant comply with all applicable provisions of
Sections 25, 26, 27, & 31 of the Mohave County Zoning
Regulations.
2. Submittal and recordation of a Parcel Plat prepared in
accordance with Article 3.16 of the Mohave County
Subdivision Regulations.
3. Lots 39 & 40 be combined through the parcel plat
procedure. (These lots have insufficient area for a C-
2H zone and therefore must be combined).
4. The establishment of a minimum lot size based on the
size of the combined parcels per the recorded Parcel
Plat.
5. The Parcel Plat shall show any surface drainage.
6. The zoning for these combined parcels be C-2H (General
Commercial Highway Frontage/Ten Thousand Square Foot
Minimum Lot Size) zone.
7. Arizona Department of Water Resources approves the
water supply and distribution system.
8. Arizona Department of Environmental Quality approves
the quantity and quality of the water supply.
9. Arizona Department of Environmental Quality approves
the use and design of the sewage treatment facility for
this development.

10. Building/Zoning permit(s) shall be obtained.
11. The development shall have adequate parking facilities.
12. All paving (driveways and parking) be paved in
accordance with Mohave County Standard Specification
#171 or better, and that such paving be completed
within ninety (90) days of the certification of
occupancy granted the building.
13. That a buffer, in the form of a six (6 ') foot block
wall shall be required along the western boundary of
Lot 39 and northern boundaries of Lots 39 & 40 where
permitted commercial uses for a C-2H zone would abut
residential uses and less intensive commercial zoning.
Construction must be coordinated with pertinent
utilities as to location of PUE and placement of block
wall.
NOTE: A ZUP must be obtained before any fabrication of
materials can be initiated as specified in Section 21.1-
C.l and said ZUP application can be processed during the
time span required to meet the above conditions.
14. The rezone shall not become effective for at least
thirty (30) days after final approval of the change in
classification by the Board of Supervisors, being May
31, 1991, as per ARS 11-829E.
15. If these conditions are not met within one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the rezoning shall schedule a
public hearing to grant an extension, determine
compliance with the schedule for development or cause
the property to revert to its former zoning
classification in accordance with Arizona Revised
Statutes Annotated, Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona, on April 14 1991, and posted April 12,

1991 as required by Arizona Revised Statutes, and the Mohave
County Zoning Regulations, and
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Wednesday, May 1, 1991 approved this
change in zoning as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
