SECTION 6, TOWNSHIP 22 NORTH, RANGE 16 WEST, FROM: A-R/I0A (AGRICULTURAL RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-R/9A (AGRICULTURAL RESIDENTIAL/NINE ACRE MINIMUM LOT SIZE) AND A-R/4A (AGRICULTURAL RESIDENTIAL/FOUR ACRE MINIMUM LOT SIZE) ZONES, LOCATED IN THE KINGMAN AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 1, 1991, a public hearing was conducted to determine whether approval should be granted to Roger and Elizabeth Sayles of Kingman, Arizona for a rezoning from existing A-R/10A (Agricultural Residential/Ten Acre Minimum Lot Size) zone to A-R/9A (Agricultural Residential/Nine Acre Minimum Lot size) and A-R/4A (Agricultural Residential/Four Acre Minimum Lot Size)) zones, located on Calle Castano 600 feet west of Cherum Road, in the Kingman area, and WHEREAS, Section 6 is located approximately 3 miles north of the Butler area and east of Stockton Hill Road. The subject property is accessed from Stockton Hill Road via Cactus Wren Drive 4 miles north of Northern Avenue) east (approx. approximately 1.5 miles to Chrum Road thence north approximately .5 miles to Calle Castano thence east 585 feet on the north side of the road, and . . Resolution No. 91-135 Page 2 PAGE 2 OF 4 BK 1883 PG 884 (FEEt91-21457) WHEREAS, review of floodplain map #040058-2155B indicates this twenty (20) acre lot to be clear of a designated floodplain. This parcel is currently occupied. Surrounding land uses consist of mostly vacant land with some residential uses. A number of the surrounding parcels to the west and east are five acre parcels. The applicant desires to split this parcel into three pieces, two lots approximately 4 acres each and one lot approximately 9 acres in size, and WHEREAS, this request is in conformance with the area plan for the Kingman area, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on April 10, 1991, the Commission recommended APPROVAL of the requested zone change contingent upon the following conditions: 1. The two southern parcels be zoned A-R/4A (Agricultural- Residential/Four Acre Minimum Lot Size) and the northern parcel be zoned A-R/9A (Agricultural- Residential/Nine Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The establishment of a minimum lot size based on the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access. 5. The two southern parcels shall meet or exceed four (4) acres and the northern parcel meet or exceed nine (9) acres exclusive of road easements. . . That the Board of Supervisors accept the dedication of a sixty (60') foot right-of-way to be named Castano Way and eight (8') foot PUE as they are contiguous to the eastern and western property line of this parcel. In addition, twenty (20') radii at the intersection of the above mentioned roadway and Calle Castano. There shall be provisions made for a turn around at the terminus of this access in accordance with and meeting the standards set forth in Mohave County regulations. This shall be approved through the recording of the resolution authorizing this zone change, and that the dedication statement and dedication be shown on the Parcel Plat. 8. A one (1') foot vehicle non-access easement and physical barrier a minimum of four (4') feet in height will need to be provided for the existing four acre parcels as they are contiguous to the above mentioned road and the easement shall be shown and dedicated via the parcel plat. 9 . The rezone shall not become effective for thirty (30) days after final approval of the classification by the Board of Supervisors, 31, 1991, as per ARS 11-829E. at least change in being May 10. If these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on April 14 1991, and posted April 12, 1991 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations, and . , Resolution No. 91-135 Page 4 PAGE -+ OF 4 BK 1883 PG 886 (FEEt91-21457) NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Wednesday, May 1, 1991 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
