PAGE 1 OF 4 MOHAVE COUNTY BOARD OF SUPERVISORS R~CORDING FEE 0.00 Me RESOLUTION NO. 91-271 A RESOLUTION SETTING FORTH THE REZONING A PORTION OF THE SW~, SEG~ION 29, TOWNSHIP 23 NORTH, RANGE 16 WEST, KNOWN AS PARCEL 505, FROM: A-R/I0A (AGRICULTURAL RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-R/6A (AGRICULTURAL RESIDENTIAL/SIX ACRE MINIMUM LOT SIZE) AND A-R/9A (AGRICULTURAL RESIDENTIAL/NINE ACRE MINIMUM LOT SIZE) ZONES, LOCATED IN THE KINGMAN AREA; MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 7, 1991, a public hearing was conducted to determine whether approval should be granted to James L. and Mary Ellen Teeter of San Diego, California for a rezoning from existing A-R/I0A (Agricultural Residential/Ten Acre Minimum Lot Size) zone to A-R/6A (Agricultural Residential/Six Acre Minimum Lot Size) and A-R/9A (Agricultural Residential/Nine Acre Minimum Lot Size) zones, occupying the northeast intersection of Hualapai Road and Calle Sonoita extensions in the Kingman area, and WHEREAS, Section 29 is located approximately six (6) miles north of the intersection of Stockton Hill road and Northern Avenue. The subject property is accessed from Stockton Hill Road via Cactus Wren Road east approximately 1.7 miles to Cherum Road thence north approximately .5 miles to Calle Castano thence east approximately 1.6 miles to Hualapai Road thence north approximately two (2) miles to the northeast corner of Calle Sonoita and Hualapai Road, and ." .. . . PAGE -- 2 OF 4- BK 1957 PG 397 (FEE~91-552g8) Resolution 91-271 Page 2 WHEREAS, review of floodplain map #040058-2155B indicates a portion of the southwest corner of this parcel, a triangle of approximately 70,000 square feet or 1.6 acres, to be in a designated floodplain. The land is currently vacant. Surrounding uses consist of mostly vacant land. A field inspection of the property during posting indicated the floodplain, then a steep slope to the north and a more gradual elevation to a bench on the east. The applicant desires to split this 25+ acre parcel into three 6+ acre parcels. After road dedications the approximate net acreage would pe 23.5 acres, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 11, 1991, the Commission recommended APPROVAL of the requested zone change contingent upon the following conditions: 1. The two eastern parcels be zoned A-R/6A (Agricultural- Residential/Six Acre Minimum Lot Size) and the western parcel be zoned A-R/9A (Agricultural-Residential/Nine Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The establishment of a minimum lot size based on the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access. 5. The two eastern parcels shall meet or exceed six (6) acres and the western parcel meet or exceed nine (9) acres exclusive of road easements. 6. The Parcel Plat shall show any surface drainage or FEMA flood zones. . PAGE 3 OF 4 BK 1957 PG 398 (FEE~91-55238) Resolution 91-271 Page 3 . 7. The Parcel Plat shall indicate topography sufficient to delineate hillsides and flood plains. The plat shall indicate potential building pad sites for the nine and six acre parcels which are outside of a designated flood zone and which are on an acceptable slope. 8. The Board of Supervisors accept the dedication of a sixty (60') foot right-of-way (a continuation of Calle Sonoi ta) along the southern boundary of this parcel. In addition, a twenty (20') foot radius at the northwest corner of Calle Sonoi ta and Avenida Burro. This shall be approved through the recording - of the resolution authorizing this zone change, and that the dedication statement and dedication be shown on the Parcel Plat. 9. No building/zoning permits shall be issued until after Parcel Plat recordation. 10. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being November 6, 1991, as per ARS 11-829E. 11. If these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on September 20, 1991, and posted September 20, 1991 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. . . Resolution 91-271 PAGE + OF + BK 1957 PG 399 (FEE~91-55288) Page 4 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, October 7, 1991 approved this change in zoning as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
