RESOLUTION NO. 91-267
A RESOLUTION SETTING FORTH THE REZONING OF THE S~ NW~ PARCEL 39,
SECTION 10, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM: A-R/SA
(AGRICULTURAL RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE,
PROPOSED TO BE: A-R/1A (AGRICULTURAL RESIDENTIAL/ONE ACRE MINIMUM
LOT SIZE) AND A-R/2A (AGRICULTURAL RESIDENTIAL/TWO ACRE MINIMUM
LOT SIZE) ZONES, LOCATED IN THE GOLDEN VALLEY AREA, - MOHAVE
COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on October 7, 1991, a public hearing was
conducted to determine whether approval should be granted to
Reynalda Lopez of Kingman, Arizona for a rezoning from existing
A-R/5A (Agricultural Residential/Five Acre Minimum Lot Size) zone
to A-R/1A (Agricultural Residential/One Acre Minimum Lot Size)
and A-R/2A (Agricultural Residential/Two Acre Minimum Lot Size)
zones, being the S~ NW~ Parcel 39, Section 10, Township 21 North,
Range 18 West, located 330 feet south of Chino Drive on the west
side of Alpine Road in the Golden Valley area, and
WHEREAS, Section 10 is approximately four (4) miles west of
the Highway 68 and 93 junction and is bisected by Highway 68.
The subject property is accessed from Highway 68 via Aztec Road
north approximately one-half (.5) mile to Chino Drive thence west
approximately six-tenths (.6) of a mile to Alpine Road thence
south approximately 330 feet on the west side of the street, and

WHEREAS, review of floodplain map #0400S8-2325B indicates a
portion of this parcel may be in a designated floodplain. The
property is currently vacant. Surrounding land uses consist of a
mixture of homes and vacant land. The applicant desires to split
this five (5+) acre parcel into one (1) two (2+) acre and two (2)
one (1+) acre parcels.
This property is located wi thin the
Valley pioneer Water Company District and the Building Code area,
and
WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on September 11, 1991, the
Commission recommended APPROVAL of the requested zone change
contingent upon the following condit~ons:
1. The two eastern parcels be zoned A-R/1A (Agricultural-
Residential/One Acre Minimum Lot Size) and the western
parcel be zoned A-R/2A (Agricultural-Residential/Two
Acre Minimum Lot Size).
2. Submittal and recordation of a Parcel plat prepared in
accordance with Article 3.16 of the Mohave County
Subdivision Regulations.
3. The establishment of a minimum lot size based on the
size of parcels per the recorded Parcel Plat.
4. Each parcel shall have legal access.
5. The two eastern parcels shall meet or exceed one (1)
acre and the western parcel meet or exceed two (2 )
acres exclusive of road easements.
6. The Parcel Plat shall show any surface drainage or FEMA
flood zones.
7. The Board of Supervisors accept the dedication of a
thirty (30') foot right-of-way along the east and west
boundaries of this parcel. In addition, an eight (8')
foot PUE along the west boundary of this parcel. This
shall be approved through the recording of the
resolution authorizing this zone change, and that the
dedication statement and dedication be shown on the
Parcel Plat.

8. No building/zoning permits shall be issued until after
Parcel plat recordation.
9. The rezone shall not become effective for at least
thirty (30) days after final approval of the change in
classification by the Board of Supervisors. Being
November 6, 1991, as per ARS 11-829E.
10. I f these conditions are not met wi thin one (1) year
this approval shall be void. I f at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the rezoning shall schedule a
public hearing to grant an extension, determine
compliance with the schedule for development or cause
the property to revert to its former zoning
classification in accordance with Arizona Revised
Statutes Annotated, Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona, on September 20, 1991, and posted
September 20, 1991 as required by Arizona Revised Statutes, and
the Mohave County zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, October 7, 1991 approved this
change in zoning as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
