PAGE 1 OF ,3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 Ne RESOLUTION NO. 91-254 A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT TO ALLOW THE ESTABLISHMENT OF A RESIDENCE IN A (S-D)C-1 (SPECIAL DEVELOPMENT/NEIGHBORHOOD COMMERCIAL) ZONE ON LOT 17, BLOCK 164, NEW KINGMAN ADDITION #10, TRACT 1103, LOCATED IN THE KINGMAN AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held September 3, 1991 a public hearing was conducted to determine whether approval should be granted to Mr. & Mrs. Matthew Puett of Kingman, Arizona for a zoning Use Permit to allow the establishment of a residence in a (S-D)C-1 zone on Lot 17, Block 164, New Kingman Addition #10, Tract 1103, located on the south side of Carver Avenue 150 feet east of North Bond Street in the Kingman area, and WHEREAS, Block 164 is approximately one (1) mile north of Northern Avenue and approximately one (1) mile east of Stockton Hill Road. Access to the subject property from Northern Avenue is via North Bond Street, and WHEREAS, review of floodplain map #0400S8-216SC indicates this area to be in a designated minor floodplain. The lot is currently vacant. WHEREAS, Staff has received one objection to this request. Another response indicated concern that the residence allowed on this site be a site built home and not a mobile home. The surrounding residences are homes and the Commission staff will probably recommend that in view of the surrounding character of the area no mobile home be placed on this property, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on August 14, 1991 and did generate a recommendation of APPROVAL of the requested Zoning Use Permit contingent upon the following conditions: 1. That Zoning/Building permit(s) be obtained. 2. If construction or use has not commenced within one (1) year of Board approval of the Zoning Use Permit or if the use has been discontinued for six (6) months, then approval shall terminate at that date. 3. This zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if in the opinion of the Commission and Board the continued use of the property would be contrary to the public health, safety, and welfare. 4.' The home shall be used as a residence only and shall not be used in conjunction with the underlying (S-D)C-1 (Special Development/Neighborhood Commercial) zoning. If the underlying (S-D)C-1 zoning were to be exercised by the owner of the property then a rehearing of this ZUP would be required. 5. This ZUP will have the same restrictions as a R-O zone and a mobile home shall not be placed on this lot. The land use map for this area indicates this to be primarily a homes only area. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on August 18, 1991, and posted August 16, "----.-- ._- ---- _..-...., ---...---.--------------. ."";._.-=.~-.,...-,~.~-.--..,-.-c'("--...-...,..-.,.-~.-,..-" - ~.. ...... BK 3 OF 1940 PG 3 63 (FEE~91-47294) 1991 as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 3, 1991 approved this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission, subject to the conditions outlined herein.
