RESOLUTION NO. 91-253 A RESOLUTION SETTING FORTH THE REZONING OF LOTS 8 7 9, BLOCK 228, NEW KINGMAN ADDITION #11, TRACT 1104, FROM: (S-D)C-2 (SPECIAL DEVELOPMENT/GENERAL COMMERCIAL) ZONE, PROPOSED TO BE: R-O (SINGLE FAMILY RESIDENTIAL/MOBILE HOMES PROHIBITED) ZONE, LOCATED IN THE KINGUAN AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 3, 1991, a public hearing was conducted to determine whether approval should be granted to the Church of the Nazarene in Kingman, Arizona for a zone change from i . , I the existing (S-D)C-2 to R-O zoning on Lots 8 & 9, Block 228, New r !'~.::'3 ':;':1 i."'~ I -, .'j ;" ~'1 L.:.;) Kingman Addition #11, Tract 1104, located on the north side of Selma Drive approximately 120 feet west of Stockton Hill Road in the Kingman area, and WHEREAS, Section 30 is located immediately north of the intersection of Stockton Hill road and Northern Avenue, Northern Avenue is the southern border of Section 30. Selma Drive is approximately .4 miles north of Northern Avenue and provides access for the subject property from Stockton Hill Road, and WHEREAS, review of floodplain map #040058-2165C indicates this area to be clear of a designated flood zone. Surrounding land uses consist of homes to the west, vacant R-1 zoning to the south southwest, vacant commercial zoning to the east and south southeast. The applicant desires to establish a house to be used as a parsonage, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 14, 1991, the Commission recommended APPROVAL of a zone change contingent upon the following conditions: 1. 2. However, if the use is discontinued, a buffer shall be required along the east and north boundaries of this development. The buffer shall be in the form of a six (6 ') foot block wall. (Commission would consider an engineered design to assure lot protection and non- access in lieu of a block wall.) 3. That zoning/Building permit(s) be obtained. 4. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors, being October 3, 1991, as per ARS 11-829E. s. If these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. ----------- .-_.- ~---- -, ------ ---.-------..------- , i :l 4 '{ j J ! Resolution No. 91-253 Page 3 "" '3 OF ,?,,/ 19~0 PG '3 .. 60 (FEE~91-~7293) WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on August 18, 1991, and posted August 16, 1991 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday.
