RESOLUTION NO. 91-251 A RESOLUTION SETTING FORTH THE REZONING OF PARCEL 164 ROADWAY EASEMENT, SECTION 1, TOWNSHIP 23 NORTH, RANGE 17 WEST, FROM: A- R/36A (AGRICULTURAL RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: A-R/10A (AGRICULTURAL RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE KINGMAN AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 3, 1991, a public hearing was conducted to determine whether approval should be granted to James L. & Mary Ellen Teeter of San Diego, California for a zone change from the existing A-R/36A to A-R/10A zoning on Parcel 164 Roadway Easement, Section 1, Township 23 North, Range 17 West, occupying the northwest intersection of Stockton Hill Road and an unnamed roadway easement in the Kingman area, and WHEREAS, Section 1 is located approximately ten (10) miles north of the intersection of Stockton Hill road and Northern Avenue. The subject property has direct access to Stockton Hill Road on the west side of the street. Access is also provided to the south portion of .the parcel from Stockton Hill Road via an unnamed roadway easement, and WHEREAS, review of floodplain map #0400S8-2000B indicates this forty (40) acre lot to be clear of a designated floodplain. Surrounding land uses consist of mostly v.acant land with some residential uses. Surrounding properties are forty acre parcels. The applicant desires to split this parcel into three 12+ acre parcels, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 14, 1991, the Commission recommended APPROVAL of a zone change from A-R/36A to A-R/10A and resultant lot split contingent upon the following conditions: 1. These parcels be zoned A-R/10A (Agricultural- Residential/Five Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3 . The establishment of a minimum lot size based on the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access. S. These parcels shall meet or exceed ten (10) acres exclusive of road easements. 6. The Parcel Plat shall show any surface drainage and FEMA designated flood zones. 7. That the Board of Supervisors accept the dedication of a fifty (50') foot right-of-way and eight (8') foot PUE as they are contiguous to the eastern and southern property lines of this parcel, being respectively Stockton Hill Road and the Falcon Valley (proposed name) Road. In addition, a twenty (20') foot radius at the intersection of the above mentioned roads. This shall be approved through the recording of the resolution authorizing this zone change, and that the dedication statement and dedication be shown on the Parcel Plat. 8. No building/zoning permits shall be issued until after Parcel Plat recordation. 9. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors, being October 3, 1991, as per ARS 11-829E. .,.. _.~_~_,__.._..,.....,._._._ _~"~.,-""-_",~_.-".___,,,___,,,,~_..C_' .,_.-~.- .. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on August 18, 1991, and posted August 16, 1991 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday.
