A RESOLUTION SETTING FORTH THE REZONING OF SE~ & NE~ & NW~ OF THE
NE~ SECTION 28, TOWNSHIP 22 NORTH, RANGE 16 WEST, TO BE KNOWN AND
SUBDIVIDED AS CHAPARRAL MESA II, TRACT 3042, FROM: A-R
(AGRICULTURAL RESIDENTIAL) ZONE, PROPOSED TO BE: (S-D)R-1/C-2
(SPECIAL DEVELOPMENT SINGLE FAMILY RESIDENTIAL GENERAL
COMMERCIAL) ZONE, LOCATED IN THE KINGMAN AREA, MOHAVE COUNTY,
ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on September 3, 1991, a public hearing was
conducted to determine whether approval should be granted to

William J. Nugent of Kingman, Arizona for a zone change from the
existing A-R to (S-D)R-1/C-2 zoning of the SE~ & NE~ & NW~ of the
NE~ Section 28, Township 22 North, Range 16 West, to be known and
subdivided as Chaparral Mesa II, Tract 3042, located north and
east of Chaparral Mesa, Tract 3024, in the Kingman area, and
WHEREAS, the project site is approximately 1,300 feet west
of Highway 66, north and adjacent to Thompson Avenue. The north
boundary of the project is Jagerson Avenue.
This project is 2
miles north of the City limits of Kingman, and
WHEREAS, review of floodplain map #0400S8-216SC indicates a

\~1 portion of this area to be in a designated floodplain. The site
tJ is currently vacant. Surrounding land uses consist of Chaparral

Mesa I to the southwest, the Butler area to the south and
approximately a mile further west, and vacant land to the north,
and
WHEREAS, the size of this development is approximately
120.48 acres. The developer proposes 583 residential lots and 1
commercial lot. The minimum lot size for the residential portion
is 6,000 square feet. The commercial lot is 100 by 193.46 feet.
The density is 4.85 units per acre, and

WHEREAS, at the public hearing before the Mohave County
Planning and zoning Commission on August 14, 1991, the Commission

Sections 25, 26, 27, and 31 of the Mohave County Zoning
Regulations. In addition to compliance with Mohave
County Ordinance 87-1 (Dark Sky Ordinance).
3. The owner accepts that whenever a "S-D" zone is
granted, each phase of stage of development of building
proposals shall be submitted to the planning staff, to
be evaluated and compared with the approved zoning plan
before any permits may be granted.
4. Any significant change (as determined by the Planning
Director - appealable to the Planning Commission) in
the approved zoning plan shall require a rehearing on
the change before the Commission, with a final
determination to be made by the Board.
Staff will maintain the most current approved ZONING
PLAN on file in the master zoning folder for reviews.

The use of this property may not be changed by the
owner/developer or subsequent owners as it is approved
unless subsequently approved by the Board in accordance
with Arizona Revised Statutes Annotated, Title II,
Chapter 6, Section 11-832.

the zoning for that phase shall become effective.
NOTE: The following apply to the commercial lots.
9. The ZONING PLAN be approved for a (S-D)C-2/18M (Special
Development/Commercial/Eighteen Thousand Square Feet
Minimum Lot Size) zone in accordance with Section 19 of
the Mohave County Zoning Regulations. This shall apply
to Block 1, Lot 1.
10. That a buffer, in the form of a six (6 ') foot block
wall shall be required along the entire boundary where
commercial uses and zoning abut residential zones.
NOTE: The following apply to the residential lots.
11. The ZONING PLAN be approved for a (S-D)R-1/6M (Special
Development/Single Family Residential/Six Thousand
Square Feet Minimum Lot Size) zone in accordance with
Section 19 of the Mohave County zoning Regulations.
This shall apply to all lots except Block 1, Lot,l.
12. All residential lots shall meet or exceed six thousand
(6,000) square feet exclusive of roadways.
13. The minimum setbacks for this development shall be
standard R-1 setbacks except rear setback of 15 feet.
14. The establishment of a minimum lot size based on the
size of lots per the recorded Final Plat.
15. Pertinent Zoning (Building) permits be obtained.
WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona, on August 18, 1991, and posted August 16,
1991 as required by Arizona Revised Statutes, and the Mohave
County Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Tuesday. Septemb.er 3, 1991 approved
this change in zoning as recommended by the Mohave County
Plannirig and Zoning Commission and outlined herein.
