PAGE 1 OF 3 ~~~ MOHAVE COUHTY BOARD OF SUPERVISORS ";6' 1, 6~ ~ ~ RECORDING FEE 0.00 He RESOLUTION NO. 91-247 A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT TO ALLOW THE ESTABLISHMENT OF A MICROWAVE STATION AS AN ADDITION TO AN EXISTING PUBLIC UTILITY FACILITY IN AN A-R (AGRICULTURAL RESIDENTIAL) ZONE ON A PORTION OF SECTION 30, TOWNSHIP 21 NORTH, RANGE 13 WEST, LOCATED IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held September 3, 1991 a public hearing was conducted to determine whether approval should be granted to the EI Paso Natural Gas Company of EI Paso, Texas for a Zoning Use " . , Permit (ZUP) to allow the establislunent of a microwave station as j I .! 4 j \ J q I I :\ I iJ 1 t ,I I '1 I ,I ~I } 'il ..~; [':":'::1' I '. . ." ~ I ';..1 t I I __.; '~j i I I I :1 I an addition to an existing public utility facility in an A-R (Agricultural Residential) zone on a portion of the Section 30, Township 21 North, Range 13 West, located one (1) mile north of the 1-40 & Highway 93 junction east of Kingman, in the Mohave County General area, and WHEREAS, Section 30 is located approximately one ( 1) mile north of the I-40 & Highway 93 junction east of Kingman. The subject property is accessed from the interchange north via Hackberry Road. The access from Hackberry Road give the natural gas facility its name of Hackberry Compressor Station, and ,--, .". ,- '-~~-____:'--'..'" . .'.r"~'- -<<"" -..- ._~ Resolution No. 91-247 . Page 2 pAA 2 OF Bk~940 PG 3 36 (FEE~91-.)7287) WHEREAS, review of floodplain map #0400S8-237SB indicates this area to be clear of a designated floodplain~ The site is currently occupied by a natural gas facility. The applicant, EI Paso Natural Gas Company, has requested the replacement of an existing antenna on the building with a separate tower and antenna. This upgrade is sought to make the facility operation safer and more efficient, and WHEREAS, a public hearing before the Mohave County Planning and zoning Commission on August 14, 1991 and did generate a recommendation of APPROVAL of the requested zoning Use Permit contingent upon the following conditions: 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. In addition to compliance with Mohave County Ordinance 87-1 (Dark Sky Ordinance). 2. That appropriate zoning/building permits be obtained. 3. If construction or use has not commenced within one (1) year of Board approval of the Zoning Use Permit or if the use has been discontinued for six (6) months, then approval shall terminate at that date. 4. This Zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if in the opinion of the Commission and Board the continued use of the property would be contrary to the public health, safety, and welfare. 5. If these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the ZUP shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. , :-t ~:;.; j .~-~ f .~-.-.~-~.~ . . ''"-' '.-~'A""-"-:""-_~.,___'-'-'-"'-~.-"-':'-:-" n,. ::......,-~ . ....,~___ Resolution No. 91-247 . page 3 P.30F B ., _ 19-W PG 3 37 (FEE~91-47287) WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on August 18, 1991, and posted August 16, 1991 as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 3, 1991 approved this zoning Use Permit as recommended by the Mohave County Planning and zoning Commission, subject to the conditions outlined herein.
