Lomas, B. HENDOMAS, INC., of Kingman, Arizona for rezoning of the NE~ NE~ SW~ NE~ Section 4, Township 21 North, Range 18 West from the existing A-R/10A zoning to A-R/1A zoning occupying the southwest intersection of Mobile Road and Belle Drive in the Golden valley area, and WHEREAS, Section 4 is approximately five (5) miles west of the Highway 68 and 93 junction and approximately one-half (.5) mile north of Highway 68. The subject property is accessed from Highway 68 via Mobile Road north approximately one and one-half ( 1.5) miles to the southwest corner of Mobile Road and Belle Drive, and WHEREAS, review of floodplain map #040058-232SB indicates this parcel to be clear of a designated floodplain. Resolution No. 91-245 . Page 2 . 2 OF 1940 PG 3 29 (FEE~91-~7285) is currently occupied. Surrounding land uses consist of mostly vacant land with some homes. There are a number of one acre parcels within this area. The applicant desires to split this 2+ acre parcel into two 1+ acre parcels. This property is located within the Valley Pioneer Water Company District and is within the Urban Overlay/Building Code area, and WHEREAS, at the public hearing before the Mohave County Planning and zoning Commission on August 14, 1991, the Commission recommended APPROVAL of the requested zone change contingent upon the following conditions: 1. These parcels be zoned A-R/1A (Agricultural- Residential/One Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The establishment of a mlnlmum lot size based on the size of parcels per the recorded Parcel Plat. 4. Each parcel shall have legal access. S. These parcels shall meet or exceed one (1) acre exclusive of roadway. 6. The Parcel Plat shall show any surface drainage and FEMA designated flood zones. 7. The parcel plat reflect conditions of Resolution 91-99 in regards to this property's frontage on Mobile Road. 8. The Board of Supervisors accept the abandonment of the existing fifty (50') roadway easement, known as Belle Drive, to be replaced by the dedication of a thirty (30') foot right-of-way and eight (8') foot PUE, as it is contiguous, to the northern property line of this parcel. The dedication of a thirty (30') foot right- of-way and twenty (20') foot FUE, as it is contiguous to the eastern property line of this parcel. In addition, the dedication of a twenty (20') foot radius at the intersection of Belle Drive and Mobile Road. No building/zoning permits shall be issued until after Parcel Plat recordation. 10. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. Being October 3, 1991, as per ARS 11-829E. 11. If these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on August 18, 1991, and posted August 16, 1991 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday. September 3, 1991 approved this change in zoning as recommended by the Mohave County Planning and zoning Commission and outlined herein.
