PAGE 1 OF 3 0.00 He RESOLUTION NO. 91-242 A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT TO ESTABLISH A TREE FARM IN AN A-R (AGRICULTURAL RESIDENTIAL) ZONE ON THE N~ SE~ PARCEL 39, RECORD OF SURVEY FOR SECTION 10, TOWNSHIP 21 NORTH, RANGE 18 WEST, LOCATED IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held September 3, 1991 a public hearing was conducted to determine whether approval should be granted to Russell Smith and Geraldine Jennings of Kingman, Arizona, for a Zoning Use Permit (ZUP) to establish a tree farm in an A-R (Agricultural Residential) zone, on the N~ SE~ Parcel 39, Record of Survey for Section 10, Township 21 North, Range 18 West, located on the west side of Amado Road in the Golden Valley area, and WHEREAS, Section 10 is approximately four (4) miles west of the Highway 68 and 93 junction and is bisected by Highway 68. The subject property is accessed from Highway 68 via Aztec Road north approximately one-half (.5) mile to Chino Drive thence west approximately one-half (.5) mile to Amado Road thence south approximately 660 feet on the west side of the street, and ! The proper~y is currently occupied by a home. Surrounding land uses consis't of some homes to the west and vacant land in the remainder of the area. The applicant desires to grow Christmas trees for seasonal sales. This use would fall in the category of a retail plant nursery which is allowed in an A-R zone with a ZUP. However, it would be a less intensive use than a standard nursery operation as sales would be limited to specific times. This property is located within the Valley Pioneer Water Company District and the Building Code area, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on August 14, 1991 and did generate a recommendation of approval of the requested Zoning Use Permit ; I ;: contingent upon the following conditions: 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. In addition to compliance with Mohave County Ordinance 87-1 (Dark Sky Ordinance). 2. That appropriate zoning/building permits be obtained. 3. This permit is being approved for a tree farm per the request of the applicant. Retail operations shall be limited to sale of Christmas trees grown on the site. Any expansion of operations shall require a rehearing of this ZUP. 4. Retail sale operations shall be limited to the months of November and December. Any expansion of operation time frame s,hall require a rehearing of this ZUP. If construction or use has not commenced within one (1) year of Board approval of the Zoning Use Permit or if the use has been discontinued for six (6) months, then approval shall terminate at that date. 5. ... 6. Adequate off-street parking accordance with Section 26 of Regulations or its successor. This Zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if in the opinion of the Commission and Board the continued use of the property would be contrary to the public health, safety, and welfare. 8 . I f these conditions are not met wi thin one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the ZUP shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the not~ce of hearing was published in the Kingman 11 Daily Miner, a newspaper of general circulation in Kingman, ~J Mohave County, Arizona on August 18, 1991, and posted August 16, 1991 as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations, and ~J NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 3, 1991 approved this Zoning Use Permit as recommended by the Mohave County . j Planning and Zoning Commission, subject to the conditions outlined herein.
