PAGE 1 OF ~ MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 HC RESOLUTION NO. 91-240 'I A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT TO ALLOW FOR THE STORAGE OF BULK FUELS IN AN M-X (HEAVY MANUFACTURING) ZONE, LOCATED IN LOT 1, BLOCK G, LAKE HAVASU ESTATES, TRACT 1168, NE~ NE~ NE~ SECTION 13, TOWNSHIP 17 NORTH, RANGE 18 WEST, LOCATED IN THE YUCCA AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held September 3, 1991 a public hearing was ., ';1 conducted to determine whether approval should be granted to the Triple G Partnership, an Arizona Partnership, for a Zoning Use permi t (ZUP) to allow for the storage of bulk fuels in an M-X (Heavy Manufacturing) zone, located in Lot 1, Block G, Lake Havasu Estates, Tract 1168, NE~ NE~ NE~ Section 13, Township 17 North, Range 18 West, located due east of the west Yucca ;:~ Interchange, in the Yucca area, and WHEREAS, the subject property is located just south of the Yucca Townsite and is adjacent to I-40's eastern border. It is accessed off of I-40 at the West Yucca Interchange, and i I j ",..,.~ ':I ~f' WHEREAS, review of floodplain map #040058-2675B indicates this property is clear of any designated floodplain. However, a ~j -.l -. - -.-j ...1 ~ site inspection of the area reveals a minor wash running east to west across the property. The property is currently occupied by .. Surrounding zoning consists of commercial, agricultural and manufacturing to the north; manufacturing to the east; residential, commercial and mul tifamily to the south and 1-40 to the west. Ford Motor Company occupies the manufacturing zone on the north and east. Surrounding land uses consist of mostly vacant land with some homes to the south, a mix of homes and businesses to the northwest and Ford Proving Grounds to the north and west, and WHEREAS, the applicant is proposing to store liquid fuels in a bulk storage facility within Lot 1 of Block G. At the recommendation of the Commission, staff held a meeting with the r applicant, Yucca Fire officials and a representative of the State Fire Marshal's office on July 19, 1991. During the course of the meeting various concerns were addressed. Primary concerns were the local fire district's ability to handle an incident at the fuel storage site. The representative from the State Fire Marshal's office indicated that communication between the local and state fire agencies would ensure steps were taken to mitigate local concerns. The applicant indicated that he would take steps to protect the well from possible contamination. The County Building Department indicated that they would also work closely with the local and state fire agencies. The applicant indicated he would, upon approval of a ZUP for this site, forward ~I;,;.ij:,,' engineered plans to the State Fire Marshall for review and obtain l the necessary County permits. Commission Staff feels the meeting U reached it objective in that all parties had opportunity to establish dialogue and suggest resolutions to spoken concerns, ; i ; i I I I .~ !j t '-, i '" ~ f. }: ~;.~;~ r: -::ci \" :c_~ i'" 'i '---'-' ~ . . ~ . r Resolution No. 9Jit40 Page 3 WHEREAS, a p~lic hearing before theM~ve County Planning and Zoning Commission on August 14, 1991 and did generate a recommendation of APPROVAL of the requested Zoning Use Permit contin~ent upon the following conditions: 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. In addition to compliance with Mohave County Ordinance 87-1 (Dark Sky Ordinance). 2. That appropriate zoning/building permits be obtained and Mohave County Building Department approves the design of the storage facility and related improvements that fall within its purview. 3. The State Fire Marshal's office, in coordination with the Yucca Fire Department, approves the design of the storage facility and related improvements. 4. Arizona Department of Environmental Quality approves the quantity and quality of the water supply. 5. Arizona Department of Environmental Quality approves measures taken to protect the existing and subsequent well(s) and groundwater from potential contamination by activities at this site. 6. Arizona Department of Environmental Quality approves the use and design of the sewage treatment facility for this development. 7 . Adequate parking shall be implemented in accordance with the Mohave County Zoning Ordinance. 8. Any remainder of the lot not used for development shall be maintained free of debris and the vegetation controlled to minimize potential fire hazards. Grasses /weeds shall be cut regularly to assure less than eight (8") inches of growth. If crushed rock is used then the soil shall be maintained in a weed free condition. 9 . Any open lot storage must be" related to or be an accessory to the primary business. . 10. The applicant shall pave the driveway access and parking in accordance with Mohave County Standard Specification #171, or better. The storage area shall be covered with a dust-proof surface. If crushed rock is used for the dust-proof surface' then the soil shall be maintained in a weed free condition. PAGE 3 OF 4 BK 1940 PG 16 (FEE~1-~7281) Resolution No. 91-240 Page 4 11. If cons4llction or use has not comAlaced within one (1) year of Board approval of the Zoning Use Permit or if the use has been discontinued for six (6) months, then approval shall terminate at that date. 12. This zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if in the opinion of the Commission and Board the continued use of the property would be contrary to the public health; safety, and welfare. 13. If these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the ZUP shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona' Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on August 18, 1991, and posted August 16, 1991 as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations, and ~-j '.
