RESOLUTION NO. 91-238 A RESOLUTION SETTING FORTH THE REZONING A PORTION OF THE W~ S~ S~ SE~ SW~ SECTION 25, TOWNSHIP 19 NORTH, RANGE 22 WEST, FROM: A-R (AGRICULTURAL RESIDENTIAL) ZONE, PROPOSED TO BE: R-O/17M (SINGLE FAMILY RESIDENTIAL/MOBILE HOMES PROHIBITED/SEVENTEEN THOUSAND SQUARE FOOT MINIMUM LOT SIZE) ZONE, LOCATED IN THE SOUTH MORAVE VALLEY AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 3, 1991, a public hearing was conducted to determine whether approval should be granted to 1 I 1 I I 1 ! r----; I '! Douglas and Kathy Echler of Las Vegas, Nevada for rezoning a portion of the W~ S~ S~ SE~ SW~ Section 25, Township 19 North, Range 22 West, from A-R (Agricultural Residential) zone to R- O/17M (Single Family Residential Mobile Homes Prohibited Seventeen Thousand Square Foot Minimum Lot Size), located in the South Mohave Valley area, and ~I WHEREAS, the subject property is accessed from Highway 95 via Joy Lane approximately 1.5 miles east on the north side of the road. This parcel has frontage on Joy Lane, and WHEREAS, review of floodplain map #040058-2445C indicates I ~-':~ this area is in a minor flood zone. This property is currently F~l vacant and surrounding land uses consist of Tierra Del Rio to the W west and proposed Allington Acres and Charisma subdivisions to "- ?-l 'rt >1 . Page 2 4, 8 (FEE~91-47279) Resolution No. 9~38 . 20F BK' 1940 PG the east with mostly vacant land to the north. The applicant desires to split this 1.47 acre parcel into three .5+ acre parcels. An existing 30' I&E exists to the east of this parcel and is proposed to be expanded and named Van Mouwerik. This street is proposed to be secondary access to a number of small subdivisions north of this parcel. The parcel to the west was approved by the Commission to be rezoned to. R-O and split into two parcels in the November 14, 1990 meeting, and WHEREAS, the applicant contacted staff after receiving her notification letter regarding the Commission's action on January 9, 1991 and asked staff to have it removed from the Board of r -~: Supervisors consent agenda and referred back ,to the Commission. 1'1 l1 The applicant felt the roadway dedication staff asked for as part ~ -I 1 i i 'I 1 ~:.~ :,~ r,',"r , -, .-,j rt.-~J !:~{:j I' j l.~ of the rezone conditions was excessive and wished to plead her case before the Commission, and WHEREAS, at the February 13, 1991 Commission meeting the applicant asked this item be Tabled. The applicant has requested this item come back before the' Commission. - for approval. The applicants has indicated concern that paving or improvement of the road will be requested. The Commission. Staff indicated to the applicant that no such condition can or will be asked in this specific case, and WHEREAS, this proposal is in conformity with the South Mohave Valley Plan, and [; , .J i.~~ 1'~::.1 t .I I ~ i U ~~_~_;"~f!;r.""""- Resolution No. 9liIJ8 Page 3 _A 3 OF ~ 1940 PG 4 9 (FEE~1-47279) WHEREAS, at the public hearing before the Mohave County Planning and zoning Commission on August 14, 1991, the Commission recommended APPROVAL of the requested zone change contingent upon the following conditions: 1. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 2. The establishment of a minimum lot size based on the size of parcels per the recorded Parcel Plat. 3. Each parcel shall have legal access. 4. Each parcel shall. meet or exceed seventeen (17,000) thousand square feet exclusive of road easements. 5. The Parcel Plat shall show any surface drainage or FEMA flood zones. 6 . That the Board of Supervisors accept the abandonment of the west fifteen (15') feet of a thirty (30') foot I&E and PUE as it is contiguous to this parcel to be replaced by the dedication of . a . thirty ( 30 ') foot right-of-way along with a five (5') foot roadway easement for potential road expansion and an eight (8') foot PUE contiguous to this property on the unnamed roadway easement (known as Van Mouwerik extended) on the east boundary of this lot in conjunction with a twenty (20 ') foot radius at the intersection of the above mentioned easement and Joy Lane. This shall be approved through the recording of the resolution authorizing this zone change, and that the dedication statement and dedication be shown on the Parcel Plat. 7. (25' ) shall foot building :setback line along be established from the front A twenty-five Van Mouwerik property line. 8. No building/zoning permits shall be issued until after Parcel Plat recordation. 9. The applicant shall not be required, as a condition of this rezone, to pay for improvements of roadways outlined in condition #6 above. 10. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on August 18, 1991, and posted August 16, 1991 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday.
