RESOLUTION NO. 91-236 A RESOLUTION SETTING FORTH APPROVAL OF A ZONING USE PERMIT TO ALLOW THE ESTABLISHMENT OF A MICROWAVE STATION AS AN ADDITION TO AN EXISTING PUBLIC UTILITY FACILITY IN AN R-E (RESIDENTIAL RECREATION) ZONE ON A PORTION OF SE~ SE~ SECTION 35, TOWNSHIP 16 NORTH, RANGE 21 WEST, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MORAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held September 3, 1991 a public hearing was conducted to determine whether approval should be granted to the f---'; EI Paso Natural Gas Company of EI Paso, Texas for a Zoning Use !, ! Permit (ZUP) to allow the establishment of a microwave station as ,--- i_ _, l:: .:. .,. I . 1 an addition to an existing public utility facility in an R-E (Residential Recreation) zone on a portion of the SE~ SE~ Section 35, Township 16 North, Range 21 West, located in the Topock portion of the South Mohave Valley area, and WHEREAS, Section 35 is located approximately three (3) miles south of Golden Shores and one-half (.5) mile east of Highway 95. The subject property is accessed from Highway 95 via an unnamed dirt road near the Topock & 1-40 interchange, and WHEREAS, review of floodplain map 4f:040058-2815C indicates this area to be clear of a designated floodplain. The site is currently occupied by a natural gas facility. The applicant, EI .. ::1 :~ . Resolution No. 91-236 . Page 2 . 20F BR 1940 PG :3 2 (FEE~91-47277) Paso Natural Gas COI~pany, has requested the repJ.acement of an' existing antenna on the building with a separate tower and antenna. This upgrade is sought to make the facility operation safer ~nd more efficient, and WHEREAS, a public hearing before the Mohave County Planning and Zoning Commission on August 14, 1991 and did generate a recommendation of APPROVAL of the requested Zoning Use Permit contingent upon the following conditions: The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. In addition to compliance with Mohave County Ordinance 87-1 (Dark Sky Ordinance). 2. That appropriate zoning/building permits be obtained. 1. 3. If construction or use has not commenced within one (1) year of Board approval of the Zoning Use Permit or if the use has been discontinued for six (6) months, then approval shall terminate at that date. 4. This Zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors, if in the opinion of the Commission and Board the continued use of the property would be contrary to the public health, safety, and welfare. 5. If these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the ZUP shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona on August 18, 1991, and posted August 16, [---,,~ , I . ." -~~ ;' ... ~ -1 ~ ~~{-~ , " 1 !-"'::':J . .. Page 3 Resolution No. 9l~6 P.30F BK- 1940 PG 3 3 (FEE~91-.H2n) 1991 as required by the Arizona Revised Statutes and the Mohave County Zoning Regulations, and NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 3, 1991 approved this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission, subject to the conditions outlined herein.
