PAGE ,1 OF :) ~Oy '96'- ~~ MOHAVE COUNTY aOARiD OF SUPERVISORS ~ ,RECORDING FEE 0.00 NC RESOLUTION NO. 91-235 A RESOLUTION SETTING FORTH THE REZONING OF :toT 7, ,BWCK 2 r MOUNTAIN VIEW RANCHES, TRACT 4003-A, FROM:A-R/5A (AGRICULTURAL RESIPE:NTrAL/FIVE ACRE MINIMUM LOT SIZE) ZONE, PROPOSEP TO BE: A- R/1.5A (AGRICULTURAL RESIPENTIAL/O:NE ANP ONE-HALF ACRE MI:NIMUM LOT SIZE) ZO:NE, LOCATEP I:N THE SOUTH MOHAVE VllLLEY AREA, MOHAVE COUNTY, ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 3/ 1991/ a public hearing was conducted to determine whether approval should be granted to Jack Lane / Jerry Bloor / and James Jones of Fort Moj ave / Arizema for rezoning of Lot 7/ Block 2/ Mountain View Ranches, Tract 4003-A, from A-R/5A (Agricultural Residential/Five Acre Minimum Lot Size) zone to A-R/l. 5A Agricultural Residential/One and one-half Acre Minimum Lot Size) / located approximately 325 feet south of the intersection of Dudley Drive and Antionette Avenue in the South Moha"e Valley area, and WHEREAS, Mountain View Ranches is located approximately five (5) miles south of Bullhead City's southern border and four (4) miles east of Highway 95. This subdivision is bisected by Boundary Cone Road. The subject property is accessed from High.lay 95 via Boundary Cone Road east approximately 4 . 75 miles to Dudley Drive thence north approximately 1700 feet on the west. side of the street, and '---=' - r : Resolution No. 91-235 . Page 2 ~ 20F 5 B~ 1939 PG 997 (FEE~1-47276) WHEREAS, review of floodplain map #040058-2445C indicates this area is not in a designated floodplain. However, when this tract was designed specific flood prone areas were designated and appear on the assessors maps. A portion of the north and northwest of Lot 7, Block 2 are designated as being in a flood prone area. It appears that a majority of this lot is outside the flood prone area and could be used as buildable area, and WHEREAS, this tract is bordered by the proposed subdivisions Copper Creek to the west and Ranch on Joy Lane to the north. Surrounding land uses for this parcel consist of mostly vacant land. Blackstone R-V Park is approximately one-quarter (.25) I 1 .1 I . ,,J mile to the south. Lot 4 of Block 2 was rezoned and legalized a three 1.5 acre parcel split in July, 1990. The majority of Lot 4 is clear of the ~lood prone designation. Lot 11 of Block 3 was denied a rezone in May, 1986. The majority of Lot 11 is in a flood prone designation, and WHEREAS, the applicants desire to split this 5+ acre parcel into three 1.5+ acre parcels, and 1 I WHEREAS, the request before the Commission was to rezone the subject property from A-R/5A (Agricultural Residential/Five Acre Minimum Lot Size) to A-R/1.5A (Agricultural Residential/One and ',", I .' I ..\ one-half Acre Minimum Lot Size). The Commission Staff had some L\:~l ! serious reservations concerning this proposal in view of the designated flood prone areas shown on the face of the final plat. Although a rezone was approved by the Commission last year, the . -----------------.--- , i I \ i .j :i (l I , ~ ':'~ ',\ r "'i l ,_'.i .' _ .,.1 ;~;;;-1 !":4 '--:.::i I, Resolution No. 91~5 It Page 3 3 OF 5 B 1939 PG 998 (FEE~91-+7276) Commission staff feels some control or policy needs to be established for the remaining parcels within this subdivision as to which lots may be split and what impact the flood prone areas have on such determinations. As development occurs on the boundary of this secti.':m, pressure will occur encouraging lot splits within this subdivision. This tract is a dry subdivision with unpaved roads, and WHEREAS, the Commission desires to APPROVE this item and develop a policy subsequent to this approval, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 14, 1991, the Commission recommended APPROVAL of an A-R/1.5A zone, with the following conditions noted: 1. The County Engineer/Planning Staff note the following condition which is tied to this tract approval by the Board of Supervisors: A. Approvals of this tract require building site pads to be constructed to a minimum elevation and a special setback as designated iby the engineer of record and as shown on the Improvement Plans. Buildings and structures are prohibited in areas that are designated as flood prone. B. As a minimum requirement, for approval for the lot split, the owner should provide a plan showing the, location of a building pad with it's special setback and minimum elevation of one ( 1') foot above the base flood for each section of the lot split. A floodplain permit. to be required as a condition of approval. C. These conditions shall be shown on the Parcel plat as a Note. ;'j :o'J , ". ~ ~;'1 i I i I '. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The establishment of a minimum lot area based on the size of the parcels per the recorded Parcel Plat. 4. Parcels shall meet or exceed acres in size exclusive of rights-of-way. one and roadway one-half ( 1. 5) easements and 5. The Parcel Plat shall indicate any surface drainage ways or FEMA designated zones. The Board of Supervisors accept the dedication of a thirty (30') foot roadway easement along the entire southern boundary and any public utility easements requested by any and all utility companies through the approval of the resolution authorizing this zone change and that the dedication statement and dedication(s) be shown on the plat. 7. No building/zoning permits shall be issued until after Parcel Plat recordation. 6. 8. The rezone shall not become effective for at least thirty (30) days after final approval of the change,in classification by the Board of Supervisors. Being October 3, 1991, as per ARS 11-829E. 9. If these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an' extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on August 18, 1991, and posted August 16, 1991 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. September 3, 1991 approved this change in zoning as recommended by the Mohave County Planning and zoning Commission and outlined herein.
