A RESOLUTION SETTING FORTH THE REZONING A PORTION OF SECTION 23,
TOWNSHIP 17 NORTH, RANGE 22 WEST, TO BE KNOWN AND SUBDIVIDED AS
COLORADO RIVERFRONT TERRACE, PHASE II, TRACT 4135, FROM: R-E
(RESIDENTIAL RECREATION) ZONE, PROPOSED TO BE: R-O (SINGLE FAMILY
RESIDENTIAL/MOBILE HOMES PROHIBITED) ZONE, LOCATED IN THE SOUTH
MORAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on September 3, 1991, a public hearing was
conducted to determine whether approval should be granted to
Frank Curcio of West Hills, California for rezoning a portion of
Section 23, Township 17 North, Range 22 West, from R-E
(Residential
Recreation)
to
R-O
(Single
Family
zone
Residential/Mobile Homes Prohibited), located on the south side
of Riverfront Parkway, approximately three-quarters (.75) mile
south of Plantation Drive, in the South Mohave Valley area, and
WHEREAS, Section 23 is located twenty (20) miles south of
Bullhead City's southern border.
Access to this South Mohave
Valley subdivision is from State Highway 95 and Higgen's Corner
south one (1) mile on Barrackman Road, thence south approximately
2,000 feet along Riverfront Parkway, entering the subdivision on
Victory Court, and

WHEREAS, review of floodplain map #040058-2615C indicates
this area to be in a designated floodplain.
Surrounding uses
consist of the recently completed Unit I, a subdivision of sixty-
one (61) lots on private land lying southerly and contiguous to
this plat. The remainder of surrounding land is state land that
is being leased/purchased by the developer and is proposed to be
developed in the future, and
WHEREAS, the project site is 4.45 acres in size. The
developer proposes development of twenty (20) lots for single
family residential use at a density of 4.4 dwelling units per
acre, with ten (10) lots fronting on the Colorado River, and
WHEREAS, this proposal is in conformity with the South
Mohave Valley Plan, and
WHEREAS, at the public hearing before. the Mohave County
Planning and Zoning Commission on August 14, 1991, the Commission
recommended APPROVAL of the requested zone change contingent upon
the following conditions:

2. The applicant comply with all applicable provisions of
Sections 25, 26, 27, and 31 of the Mohave County zoning
Regulations. In addition to compliance wi th Mohave
County Ordinance 87-1 (Dark Sky Ordinance).
3.
The establishment of a minimum lot size based on the
size of lots per the recorded Final Plat.
All residential lots shall meet or exceed six thousand
(6,000) square feet exclusive of roadways.

5. The minimum setbacks for this development shall be the
standard, R-O setbacks as described in the regulations
except the rear setbacks for Lots 1-10 shall be 40' to
avoid potential conflicts with proximity of development
to the river bank of the Colorado River.
6. No primary or accessory structures shall be built
within the Bureau of Reclamation easement shown on the
Preliminary Plat. This applies to Lots 14-20.
7. Parcels B & C shall be for landscaping purposes only.
8. Pertinent Zoning (Building) permits be obtained.
9. The rezone shall become effective upon the recordation
of the Final Plat. If development is phased, then only
the zoning for that phase shall become effective.
WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona, on August 18, 1991, and posted August 16,
1991 as required by Arizona Revised Statutes, and the Mohave
County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Tuesday. September 3 , 1991 approved
this change in zoning as recommended by ,the Mohave County
Planning and Zoning Commission and outlined herein.
