A RESOLUTION SETTING FORTH THE REZONING OF ALL LOTS AND PARCELS
IN SECTION 35, TOWNSHIP 19 NORTH, RANGE 22 WEST, TO BE KNOWN AND
SUBDIVIDED AS DESERT LAKES GOLF COURSE AND ESTATES, UNIT VI,
TRACT 4132, FROM: R-M (MULTIPLE FAMILY RESIDENTIAL) ZONE,
PROPOSED TO BE: (S-D)R-O/6M (SPECIAL DEVELOPMENT/SINGLE FAMILY
RESIDENTIAL/MOBILE HOMES PROHIBITED/SIX THOUSAND SQUARE FOOT
MINIMUM LOT SIZE) ZONE, LOCATED IN THE SOUTH MOHAVE VALLEY AREA,
MORAVE COUNTY, ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on September 3, 1991, a public hearing was
conducted to determine whether approval should be granted to
Angelo Rinaldi of Desert Lakes Development of Fort Mohave,
Arizona for a rezoning from existing R-M (Multiple Family
Res idential) zone to (S-D) R-O / 6M (Special Development Single
Family Residential/Mobile Homes prohibited/Six Thousand Square
Foot Minimum Lot Size) zone, and
WHEREAS, Section 35 is located three (3) miles south of
Bullhead City's southern border and is bounded by Highway 95, Joy
Lane, Mountain View Road and Lipan Boulevard.
The property is
located south of Joy Lane approximately three-quarters (.75) mile
east of Highway 95, and
WHEREAS, review of floodplain map #040058-2445C indicates
this area to be within a designated flood plain. The property is

currently vacant.
Surrounding land uses consist of Joy Lane
Elementary School to the west, Desert Lakes, Tract 4076 to the
south, Fairway Estates, Tract 4097 to the east and residential
uses to the north.
The site is 8.7 acres in size.
Proposed
development consists of 38 lots with a minimum size of 6,000
square feet.
Proposed gross density is 4.4 dwelling units per
acre, and
WHEREAS, the site is currently zoned R-M. The Commission is
processing the zoning prior to the approval of the preliminary
plat in order to clear up any confusion. regarding the existing
multifamily zoning and the subsequent placement of single family

WHEREAS, this proposal is in conformity with the South
Mohave Valley Plan, and
WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on August 14, 1991, the Commission
recommended APPROVAL of the requested zone change contingent upon
the following conditions:

Sections 25, 26, 27, and 31 of the Mohave County zoning

5. The owner accepts that whenever a "S-D" zone is
granted, each phase of stage of development of building
proposals shall be submitted to the plarining staff, to
be evaluated and compared with the approved zoning plan
before any permits may be granted.

owner/developer or subsequent owners as it is approved
unless subsequently approved by the Board in accordance
with Arizona Revised Statutes Annotated, Title II,
Chapter 6, Section 11-832.
9. The ZONING PLAN be approved for a (S-D)R-O/6M (Special
Development/Single Family Residential Mobile Homes
Prohibited/Six Thousand Square Feet Minimum Lot Size)
zone in accordance with Section 19 of the Mohave County
Zoning Regulations.
10. The minimum setbacks for this development shall be the
standard R-O ~:etbacks as described in the regulations
except the rear setback which shall be twenty (20 ')
feet.
11. The S-D plan shall indicate minimum setbacks for all
lots and specifically non-rectangular lots. Any
changes in preliminary plat design shall be shown on a
"new" S-D plan.

Mohave County, Arizona, on August 18, 1991, and posted August 16,

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Tuesday, September 3, 1991 approved
this change in zoning as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
